Definition: A condition of arrested or incomplete development of the mind, which is especially characterized by impairment of skills manifested during the developmental period, skills which contribute to the overall level of intelligence, i.e. cognitive, language, motor, and social abilities. Retardation can occur with or without any other mental or physical condition. Degrees of mental retardation are conventionally estimated by standardized intelligence tests. These can be supplemented by scales assessing social adaptation in a given environment. These measures provide an approximate indication of the degree of mental retardation. The diagnosis will also depend on the overall assessment of intellectual functioning by a skilled diagnostician. Intellectual abilities and social adaptation may change over time, and, however poor, may improve as a result of training and rehabilitation. Diagnosis should be based on the current levels of functioning.
Omschrijving: Een toestand van tot stilstand gekomen of onvolledige ontwikkeling van het verstand, die vooral wordt gekenmerkt door een tijdens de ontwikkelingsperiode aan het licht tredende stoornis van vaardigheden, die mede bepalend is voor het algehele intelligentieniveau, d.w.z. cognitieve, verbale, motorische en sociale vermogens. Zwakzinnigheid kan voorkomen met of zonder een andere psychische of lichamelijke aandoening. Het is gebruikelijk de graad van zwakzinnigheid te schatten aan de hand van gestandaardiseerde intelligentietests. Deze kunnen worden aangevuld met schaalindelingen die de sociale aanpassing onder gegeven omstandigheden bepalen. Deze metingen geven een benadering van de graad van zwakzinnigheid. De diagnose zal ook afhankelijk zijn van de algehele beoordeling van het verstandelijk functioneren door een ervaren diagnosticus. In order to ensure that this Directive is fully operational and to adapt it to technical, scientific and international developments in tobacco manufacture, consumption and regulation, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission in respect of adopting and adapting maximum emission levels and methods for measuring those emissions, setting maximum levels for additives that result in a characterising flavour or that increase toxicity or addictiveness, withdrawing certain exemptions granted to tobacco products other than cigarettes and roll-your-own tobacco, adapting the health warnings, establishing and adapting the picture library, defining the key elements of the data storage contracts to be concluded for the purposes of the tracking and tracing system, and extending measures adopted by Member States to the entire Union concerning specific electronic cigarettes or refill containers or a type of electronic cigarette or refill container.

(18) Whereas the application of the country-of-origin principle contained in this Directive could pose a problem with regard to existing contracts; whereas this Directive should provide for a period of five years for existing contracts to be adapted, where necessary, in the light of the Directive; whereas the said country-of-origin principle should not, therefore, apply to existing contracts which expire before 1 January 2000; whereas if by that date parties still have an interest in the contract, the same parties should be entitled to renegotiate the conditions of the contract;
