The disparities meant that counterfeiting and piracy were concentrated in particular areas of the European Union because counterfeit and pirated products tended to be manufactured and sold in the countries where the repression of counterfeiting and piracy was less effective than in others.
Deze verschillen hebben namelijk gevolgen voor de plaats waar de namaak en de piraterij binnen de Europese Unie plaatsvinden: de betrokken producten worden doorgaans vooral vervaardigd en verkocht in de landen die namaak en piraterij het minst doeltreffend bestraffen.

1. It extends the scope of the legislation so that it covers not only counterfeit goods, as at present, but also pirated goods, (i.e. goods made without the consent of the holder of the copyright or related rights, including designs rights. 2. It broadens the definition of the term "counterfeit goods" to take in not only the goods themselves, as is already the case, but the actual trade mark symbol (logo), packaging bearing the marks of the products, and tools, moulds or similar materials specifically intended for the manufacture of counterfeit marks or products. 3. It allows the customs authority itself to decide on applications by trade mark owners (in some Member States applications currently have to go through the judicial authorities, a time-consuming and cumbersome procedure).
Een verbetering van de vroegere procedure Bij de toepassing van de verordening ter bestrijding van de invoer van namaakartikelen die in 1986 door de Raad werd goedgekeurd bleek dat sommige punten voor verbetering vatbaar waren. De nieuwe verordening bevat derhalve de volgende wijzigingen ten opzichte van de oude verordening : - Een uitbreiding van het toepassingsgebied van de verordening waardoor deze niet alleen betrekking heeft op namaakartikelen, maar ook op illegaal gereproduceerde goederen, dat wil zeggen goederen die zonder de toestemming van de houder van het auteursrecht of van het aanverwante recht zijn vervaardigd, en op tekeningen en modellen. - Een verruiming van de definitie van nagemaakte goederen. Hieronder worden nu niet alleen goederen verstaan die ten onrechte van een merk zijn voorzien, maar ook goederen die ten onrechte van beeldmerken (logo's) zijn voorzien, verpakkingsmateriaal waarop ten onrechte merken van produkten zijn aangebracht, en gereedschappen, matrijzen of materiaal dat speciaal voor de vervaardiging van een namaakartikel is bestemd. - Toekenning van de bevoegdheid aan de douane om te beslissen over verzoeken van de houder van het merk. In sommige Lifd-Staten moeten dergelijke verzoeken bij een gerechtelijke instantie worden ingediend, wat tot vrij zware en langdurige procedures leidt.
