Definition: A disorder characterized by impairment of memory, learning difficulties, and reduced ability to concentrate on a task for more than brief periods. There is often a marked feeling of mental fatigue when mental tasks are attempted, and new learning is found to be subjectively difficult even when objectively successful. None of these symptoms is so severe that a diagnosis of either dementia (F00-F03) or delirium (F05.-) can be made. This diagnosis should be made only in association with a specified physical disorder, and should not be made in the presence of any of the mental or behavioural disorders classified to F10-F99. The disorder may precede, accompany, or follow a wide variety of infections and physical disorders, both cerebral and systemic, but direct evidence of cerebral involvement is not necessarily present. It can be differentiated from postencephalitic syndrome (F07.1) and postconcussional syndrome (F07.2) by its different etiology, more restricted range of generally milder symptoms, and usually shorter duration.

2. The Authority shall act within the powers conferred by this Regulation and within the scope of Directive 97/9/EC, Directive 98/26/EC, Directive 2001/34/EC, Directive 2002/47/EC, Directive 2003/6/EC, Directive 2003/71/EC, Directive 2004/39/EC, Directive 2004/109/EC, Directive 2009/65/EC and to Directive 2006/49/EC, without prejudice to the competence of the European Supervisory Authority (European Banking Authority) in terms of prudential supervision, any future legislation in the area of Alternative Investment Fund Managers (AIFM), and Regulation (EC) No 1060/2009, and, to the extent that these acts apply to firms providing investment services or to collective investment undertakings marketing their units or shares and the competent authorities that supervise them, within the relevant parts of, Directive 2002/87/EC, Directive 2005/60/EC, Directive 2002/65/EC, including all directives, regulations, and decisions based on those acts, and of any further legally binding Union act which confers tasks on the Authority.
2. ... on the draft Commission Directive amending Directive 90/388/EEC as regards mobile and personal communications; sent the President-in-Office of the Council, on 29 September 1995, the draft Commission Directive amending Directive 90/388/EEC as regards the implementation of full competition in telecommunications markets; - NOTES also the public consultation launched by the Commission following the publication of the two draft Directives in the Official Journal of the European Communities; - REAFFIRMS that it is important that the conditions governing the definition of the Community's future policy on the liberalization of telecommunications services and infrastructures should result from a political agreement based on the compromise of December 1989 and takes note of the Commission's support for this approach; - RECALLS in this connection the political agreement reached at the Telecommunications Council meeting on 17 November 1994, which was given concrete form in the Council Resolution of 22 December 1994 and in the statements made on that occasion; RECALLS that this Resolution recognizes in particular the principle of liberalization of telecommunication infrastructures on 1 January 1998, on the understanding that an additional transitional period is granted to certain Member States; - POINTS OUT that the Commission must also take account in its approach of the responsibilities of the European Parliament and the Council for the legislative provisions designed, on the basis of Commission proposals, to establish the European regulatory framework for telecommunications, particularly as regards interconnection rules, universal service provision, access to frequencies for terminal equipment and licensing; of the need for consistency and balance between the processes of harmonization and liberalization; of the time that may be required by the Member States for adopting national measures to implement the Directives proposed by the Commission; - EMPHASIZES that these conclusions are without prejudice to the Member States' respective positions on the form and content of the draft Directives submitted by the Commission; - NOTES in this connection that, when this text was examined by the Council's subordinate bodies, many questions were put to the Commission by the Member States and that since then most of the Member States have also forwarded written comm ...

ER NOTA VAN dat de Commissie op 3 augustus 1995 heeft verzocht om eventuele opmerkingen van de Raad over de ontwerp-richtlijn van de Commissie tot wijziging van Richtlijn 90/388/EEG met betrekking tot de mobiele communicatie en personal communications ; de fungerend Voorzitter van de Raad op 29 september 1995 de ontwerp- richtlijn van de Commissie heeft doen toekomen tot wijziging van Richtlijn 90/388/EEG met betrekking tot de volledige openstelling voor de mededinging van de markten voor telecommunicatiediensten ; - NEEMT tevens NOTA van de openbare raadpleging die de Commissie op gang heeft gebracht na de bekendmaking van de twee voornoemde ontwerp- richtlijnen in het Publikatieblad van de Europese Gemeenschappen ; - VERKLAART OPNIEUW dat het van belang is dat de voorwaarden waaronder het toekomstige beleid van de Gemeenschap inzake de liberalisatie van de telecommunicatie-infrastructuur en -diensten wordt bepaald, voortvloeien uit een politiek akkoord dat geënt is op het compromis van december 1989 en neemt er akte van dat de Commissie deze aanpak steunt ; - HERINNERT aan het politieke akkoord dat tijdens de zitting van de Raad Telecommunicatie van 17 november 1994 is bereikt en dat gestalte heeft gekregen in de resolutie van de Raad van 22 december 1994 en in de bij die gelegenheid afgelegde verklaringen ; HERINNERT ERAAN dat in die resolutie met name het beginsel van de liberalisatie van de telecommunicatie- infrastructuur vóór 1 januari 1998 wordt erkend, met dien verstande dat er aan een aantal Lid-Staten een aanvullende overgangsperiode wordt toegekend ; ". - HERINNERT ERAAN dat de Commissie bij haar aanpak ook rekening moet houden met de bevoegdheden van het Europees Parlement en de Raad inzake de wettelijke bepalingen om, op basis van voorstellen van de Commissie, het Europese regelgevende kader voor de telecommunicatie vast te stellen, met name op het gebied van interconnectieregels, universele dienstverlening, toegang tot de frequenties, eindapparatuur en vergunningen ; de nodige samenhang en het evenwicht tussen het harmonisatieproces en het liberalisatieproces ; de termijnen die de Lid-Staten nodig kunnen hebben om de nationale maatregelen ter toepassing van de door de Commissie overwogen richtlijnen aan te nemen ; - WIJST EROP dat de huidige conclusies niet vooruitlopen op de respectieve standpunten van de Lid-Staten ten aanzien v ...
