‘The European Community hereby declares that, when amending Council Regulation (EC) No 44/2001 on jurisdiction, recognition and enforcement of judgments in civil and commercial matters, it intends to clarify the scope of Article 22(4) of the said Regulation with a view to taking into account the relevant case law of the Court of Justice of the European Communities with respect to proceedings concerned with the registration or validity of intellectual property rights, thereby ensuring its parallelism with Article 22(4) of the Convention while taking into account the results of the evaluation of the application of Regulation (EC) No 44/2001’.
«La Communauté européenne déclare que, lors de la modification du règlement (CE) no 44/2001 du Conseil concernant la compétence judiciaire, la reconnaissance et l’exécution des décisions en matière civile et commerciale, elle entend préciser le champ d’application de l’article 22, paragraphe 4, dudit règlement pour tenir compte de la jurisprudence pertinente de la Cour de justice des Communautés européennes relative aux procédures en matière d’inscription ou de validité de droits de propriété intellectuelle, de façon à l’aligner sur l’article 22, paragraphe 4, de la convention, tout en tenant compte des résultats de l’évaluation de l’application du règlement (CE) no 44/2001».

During the negotiations of the Convention the Community committed itself to making a declaration, at the time of ratification of the Convention, to the effect that when amending Regulation (EC) No 44/2001 the Community would clarify the scope of Article 22(4) of the said Regulation with a view to taking into account the relevant case law of the Court of Justice of the European Communities with respect to proceedings concerned with the registration or validity of intellectual property rights, thereby ensuring its parallelism with Article 22(4) of the Convention.
Durant les négociations relatives à la convention, la Communauté s’est engagée à faire, au moment de la ratification de la convention, une déclaration selon laquelle, lors de la modification du règlement (CE) no 44/2001, la Communauté précisera le champ d’application de l’article 22, paragraphe 4, dudit règlement afin de tenir compte de la jurisprudence pertinente de la Cour de justice des Communautés européennes relative aux procédures en matière d’inscription ou de validité de droits de propriété intellectuelle, de façon à l’aligner sur l’article 22, paragraphe 4, de la convention.

2. Where application of paragraph 1 results in a reduction of the rights or an extension of the general authorisations and individual rights of use already in existence, Member States may extend the validity of those authorisations and rights until 30 September 2012 at the latest, provided that the rights of other undertakings under Community law are not affected thereby.
2. Lorsque l’application du paragraphe 1 conduit à restreindre les droits ou à étendre les autorisations générales et les droits individuels d’utilisation existants, les États membres peuvent proroger la validité de ces autorisations et droits jusqu’au 30 septembre 2012 au plus tard, sous réserve qu’une telle mesure n’affecte pas les droits d’autres entreprises au titre du droit communautaire.
