By letter dated 9 December 2011 (5), the Commission informed Austria that it had decided to initiate the procedure laid down in Article 108(2) of the Treaty on the Functioning of the European Union (‘the Treaty’) in respect of the recapitalisation of EUR 1 billion and the guarantee of EUR 3 billion granted by Austria to ÖVAG, and requested Austria to submit an amended restructuring plan, the final version of which was submitted on 4 September 2012 (‘the 2012 restructuring plan’).

On 26 January 2012, the Commission decided (5) to temporarily approve the recapitalisation measure of LVL 70,2 million granted on 23 March 2010, a recapitalisation measure of LVL 50 million granted to the bank at the end of 2011 (granted as a liquidity measure to be converted into capital), a standby liquidity facility of up to LVL 250 million for the bank, guarantees to international creditors of the commercial segment of MLB of up to LVL 32 million and liquidity support of up to LVL 60 million for the solvent liquidation of the bad assets within HipoNIA, an asset management company owned and financed by MLB, and to initiate the procedure laid down in Article 108(2) of the Treaty on the Functioning of the European Union (‘the Treaty’) in respect of those measures in so far as they were needed for the restructuring of the commercial segment of MLB (‘restructuring measures’) and benefitted its development segment and in respect of the transformation plan of MLB (6) (‘the opening decision’).The Commission had doubts as to the compatibility of the restructuring measures with the internal market in the light of the Commission's Communication on the return to viability and the assessment of restructuring measures in the financial sector in the current financial crisis under the State aid rules (7) (‘the Restructuring Communication’).

La Commission a également décidé le même jour d'ouvrir la procédure prévue à l'article 108, paragraphe 2, du traité sur le fonctionnement de l'Union européenne (ci-après le «traité») concernant les mesures précitées afin de déterminer si celles-ci étaient nécessaires aux fins de la restructuration de l'activité «banque commerciale» de MLB (ci-après les «mesures de restructuration») et avaient conféré un avantage à l'activité «banque de développement» de cette dernière, ainsi que concernant le plan de transformation de MLB (6) (ci-après la «décision d'ouvrir la procédure»). La Commission doutait de la compatibilité des mesures de restructuration avec le marché intérieur à la lumière de la communication de la Commission sur le retour à la viabilité et l'appréciation des mesures de restructuration prises dans le secteur financier dans le contexte de la crise actuelle, conformément aux règles relatives aux aides d'État (7) (ci-après la «communication sur la restructuration»).

The Commission decided today to open a procedure with respect to restructuring aid granted for Triptis Porzellan GmbH, situated in Triptis, in the new German Bundesland Thüringen, provided by the Bundesanstalt für vereinigungsbedingte Sonderaufgaben (BvS), the successor to the Treuhandanstalt.
La Commission a décidé ce jour d'ouvrir une procédure à l'égard d'une aide à la restructuration accordée à Triptis Porzellan GmbH, située à Triptis, dans le nouveau land de Thuringe, par le Bundesanstalt für vereinigungsbedingte Sonderaufgaben (BvS), successeur de la Treuhandanstalt.

Having taken into account first the uncertanity about the exact amount of aid and secondly the overcapacity within the porcelain sector, the uncertain competitive effect of the aid and that no further capacity reductions are planned, the Commission has decided to initiate the procedure against the aid granted to Triptis Porzellan GmbH.
Compte tenu, d'une part, de l'incertitude quant au montant exact de l'aide et, d'autre part, de la surcapacité du secteur de la porcelaine, des effets incertains de l'aide sur la concurrence et du fait qu'aucune nouvelle réduction de capacité n'est prévue, la Commission a décidé d'engager la procédure à l'égard de l'aide accordée à Triptis Porzellan GmbH.

In the opening of the procedure the Commission indicated that it would check whether the aid had been granted on the basis of a sound restructuring plan and whether the conditions laid down in the Community guidelines on State aid for rescuing and restructuring firms in difficulty had been respected.
