One of the main sources of social dumping nowadays is abuse of the Posted Workers Directive by companies with mafia practices which mainly employ Romanian and Bulgarian workers because of their weaker position and then exploit them using that legal framework. With this in mind, does the Commission intend to do anything to protect these workers and stop social dumping in ways that do not allow Member States to make the workers themselves illegal rather than outlawing the exploitation of those workers by certain mafia companies operating at EU level?

5. Calls on the Commission to prepare a set of clear indicators, and a better methodology based on economic and social indicators, which can be used to assess whether there is a clear justification for extending the total or partial restrictions imposed by Member States to counter the negative disturbances on their national labour markets that could be caused by Romanian and Bulgarian workers, and also to employ this approach when a Member State requests authorisation to implement the safeguard clause;

The Court has previously held that where the employment relationship has terminated, the worker is entitled to an allowance in lieu in order to prevent all enjoyment of that right to leave being lost. EU law precludes national legislation or practices under which an allowance in lieu is not due to the worker at the end of the employment relationship, although the worker could not benefit from his right to paid annual leave because of his illness.

Calls on those Member States which have decided, under the EU Accession Treaty for Romania and Bulgaria, to introduce a seven-year moratorium, until 1 January 2014, on the right to free movement within the EU for workers from those two countries, or to continue applying transitional arrangements restricting access by Romanian and Bulgarian nationals to their labour markets , to review their decisions as soon as possible, taking into consideration the principle of equality, the prohibition of discrimination, the unjustified nature of those decisions and the principle of solidarity, so that the employment rights associated with EU citizenship are no longer restricted for Romanian and Bulgarian citizens;

Hearing the case, the Landesarbeitsgericht (Higher Labour Court, Germany) asks the Court of Justice whether national legislation or practice which provides that, if the employment relationship ends because of the worker’s death, the entitlement to paid annual leave is lost without giving rise to an allowance in lieu of outstanding leave is compatible with EU law.

As the meeting agenda was fairly extensive, the first part focused on the main challenges facing Europe in an uncertain climate. As mentioned by group president Mario Sepi in the introduction to his speech, this uncertainty results from unfamiliarity with the new Commission's programme, an unpredictable ratification process for the Constitutional Treaty and even the degeneration of industrial relations in many countries, caused by employers' erosion of workers' entitlements, often with the complicity of the State. Mr Sepi emphasised that these aspects were interlinked, because "the choices made for relaunching the Lisbon Strategy will certainly have an impact on the way Europe is seen by the millions of citizens called to vote on the constitution". Mr Sepi concluded his speech by recalling the three main priorities for the future of Europe and its model: the mid-term review of the Lisbon Strategy "striking a balance with each side of its equilateral triangle, that is, the economic, social and environmental aspects"; the Stability and Growth Pact, "which must be reviewed not only in terms of economic flexibility but also in terms of quality of expenditure"; the EU's financial perspectives, which must (as G. Dassis' opinion made clear) take account of the cohesion objectives if we are to determine the financial resources needed to realise our ambitions.

In view of the labour market situation in Luxembourg, the ESF assistance will take the practical form of particular support for: - anticipation based on a contractual policy with the social partners, giving preference to an intersectoral and regional approach to worker training and to supportive measures for training structures; - preventing staff affected by industrial change and changes in production systems from being excluded from the labour market because the current level or type of their qualifications is incompatible with the technical demands brought about by these changes; - adapting staff qualifications and skills to the tasks and division of responsibilities generated by the new forms of industrial organisation; - providing support for occupational mobility within or outside the undertaking and limiting any negative consequences for individuals which may result; - improving workers' access to training, particularly for persons employed in SMEs, and familiarising small businesses with the concept of training plans.
