It must, however, be pointed out that the fact that the Board of Appeal did not reproduce all of the arguments of one party and the evidence provided by that party, or did not reply to each of those arguments and items of evidence, cannot by itself lead to a finding that the Board of Appeal refused to take them into account (judgment of 9 December 2010 in Tresplain Investments v OHIM — Hoo Hing (Golden Elephant Brand), T‑303/08, ECR, EU:T:2010:505, paragraph 46).

As regards the first complaint, alleging that the evidence referred to in paragraph 10 above was not duly examined, it must, first, be pointed out that it is in no way apparent from the contested decision that the Board of Appeal refused to take into consideration any arguments or evidence submitted by the applicant.

Furthermore, at paragraphs 82 and 81 of the judgments in T-109/08 and T-110/08 respectively, the Court held that, as regards the argument that none of the illustrations of the bottles of sparkling wine in the contested decisions referred to a bottle marketed at the time registration of the marks was sought, it was sufficient to point out that that argument was ineffective in so far as the Board of Appeal of OHIM had rightly stated, in those decisions, that ‘there [was] no history of wine producers having offered wine to the public in bottles without inscription, by solely or principally relying on the formal appearance of the bottle as the indicator of the industrial or commercial origin of the product’.

That is a different criterion from the one which emerges from the General Court’s case-law, according to which the purpose of measures of organisation of procedure (covered by Article 64 of the Rules of Procedure of the General Court) is to ensure efficient conduct of the written and oral procedure and to facilitate the taking of evidence, and also to determine the points on which the parties must present further argument or which call for measures of inquiry, whereas measures of inquiry (covered by Articles 65 to 67 of those Rules) are intended to prove the veracity of the facts alleged by one of the parties in support of its pleas in law (Case T‑141/01 Entorn v Commission [2005] ECR II‑95, paragraphs 129 and 130).

As regards the Board of Appeal’s argument that the shape of the product constituting the trade mark applied for cannot perform a trade mark function from the relevant consumers’ point of view on the ground that that mark is essentially dictated by aesthetic considerations (paragraphs 14 to 18 of the contested decision), it suffices to state that, in so far as the relevant public perceives the sign as an indication of the commercial origin of the goods or services, whether or not it serves simultaneously a purpose other than that of indicating commercial origin is immaterial to its distinctive character (Case T-173/00 KWS Saat v OHIM (Shade of orange) [2002] ECR II-3843, paragraph 30.Grille, paragraph 43; and Case T-129/04 Develey v OHIM (Shape of a plasticbottle) [2006] ECR II-811, paragraph 56).
