The second part of the single plea of the application, alleging a manifest error of assessment, is not supported by any arguments, contrary to the rule contained in Article 35(1)(e) of the Rules of Procedure in force when the action was brought and restated in Article 50(1)(e) of the Rules of Procedure.

As regards the applicant’s first argument, the Tribunal notes that it is clear, from a simple comparison between the list of the functions to be performed by the temporary agent in grade AD 5 who was to be recruited, as given in the vacancy notice, and the list of functions in the job description for the post occupied by the applicant when he was a seconded national expert, that that argument has no basis in fact.
