The European Union wishes to keep citizens informed about and involved in environmental matters and to improve the application of environmental legislation by approving the Convention on access to information, public participation and access to justice in environmental matters (Århus Convention).

We have a similar situation in the Laval case, where there is in turn a situation in Sweden where minimum pay is not prescribed either by statute or in a collective agreement in the manner envisaged in the Posting of Workers Directive. It is my view, therefore, that the way out of this situation is primarily through the adaptation of national legislation to the provisions of the current Directive, although I concede that there are many matters that could still be improved in the Directive, and in these matters I support the Commission’s opinion.

As regards criminal legal matters, legislation must sometimes be approximated and minimum legal procedural standards must be set up if mutual confidence between Member States is to be strengthened.

(14) In order to ensure the correct application of this Regulation, it is necessary to provide with a rapid and efficient exchange of information about means of identification and related documents between Member States. Community provisions relating thereto have been established by Council Regulation (EC) No 515/97 of 13 March 1997 on mutual assistance between the administrative authorities of the Member States and co-operation between the latter and the Commission to ensure the correct application of the law on customs and agricultural matters and by Council Directive 89/608/EEC of 21 November 1989 on mutual assistance between the administrative authorities of the Member States and co-operation between the latter and the Commission to ensure the correct application of legislation on veterinary and zootechnical matters.

That said, there is also a completely unjustifiable complexity in this matter. We are experiencing legislative chaos, procedural chaos and linguistic chaos.

Legislation must be updated and harmonised and supervisory authorities simplified and consolidated and, of course, new technologies are needed to protect telecommunications from disproportionate and unjustified interference.
