(2) A registration mark or a special registration mark issued pursuant to subsection (1) is cancelled if the aircraft is not registered in Canada within 12 months after the day on which the registration mark was issued.

40 (1) When an application for registration of a trade-mark, other than a proposed trade-mark, is allowed, the Registrar shall register the trade-mark and issue a certificate of its registration.

(4) A registration mark or a special registration mark that is reserved under subsection (1) may be applied to an aircraft that is registered on a foreign register but shall be kept covered until the mark is issued to that aircraft.

By deducing the similarity between the signs and the likelihood of confusion between the marks at issue from the similarity of elements of the signs — which correspond to a plainly descriptive indication for the condition of the goods (namely ‘navy blue’ as the colour indication for the goods utilised by the marks at issue) and, due to lack of inherent distinctive character, are not considered by the relevant public to be an indication of the commercial origin of the goods from a particular undertaking as distinguished from goods of other undertakings — the General Court misinterpreted that rule and the settled case-law on the determination of the similarity between the signs and the likelihood of confusion.

In particular, several other components of the marks at issue have dominant aspects, including the colour combination of the mark at issue and the opposing figurative mark and the ‘LA’ label.

The General Court observes that, even though a direct link cannot be established between the goods covered by the marks at issue, which are dissimilar, an association with the earlier mark is still possible, having regard to the high degree of similarity between the signs and to the huge reputation acquired by the earlier mark which extends beyond the public concerned by the goods for which it has been registered.
