5. Exceptionally, where early access is necessary to respond to a specific and actual threat related to terrorist offences or serious crime, the Passenger Information Unit of a Member State shall have the right to request the Passenger Information Unit of another Member State to provide it with PNR data of flights landing in or departing from the latter’s territory at any time.

4. Member States shall inform the Commission, no later than three months after the entry into force of this Decision, which experts comprise their National Contact Point, specifying how the latter respond to the requirements set out in paragraph 3.
4. Les États membres communiquent à la Commission, au plus tard trois mois après l’entrée en vigueur de la présente décision, le nom des experts qui composent leur point de contact national, en précisant comment ces derniers remplissent les conditions fixées au paragraphe 3.

The latter may, within three months of receipt, present its observations; those observations shall include, where relevant, the measures which it has taken or intends to take to respond to the review within a given timescale.
Ce dernier peut présenter ses observations dans les trois mois suivant la réception du rapport. Ses observations comportent, le cas échéant, les mesures qu'il a prises ou qu'il envisage de prendre pour donner suite à l’évaluation dans un délai déterminé.
