Since the ECJ judgement in 2011, Greece has made some improvements and has taken action to remedy the shortcomings in its asylum system, closely monitored by the Commission, European Asylum Support Office and Member States.

On 28 April 2011, the ECJ delivered a judgement in case C-61/11 (El Dridi). In this far reaching judgement, the ECJ found that the Return Directive precludes national rules imposing a prison term on an illegally staying third-country national who does not comply with an order to leave the national territory, because such penalty is liable to jeopardise the attainment of the objective of introducing an effective policy for removal and repatriation in keeping with fundamental rights.
Le 28 avril 2011, la CJUE a rendu, dans l’affaire C-61/11 (El Dridi.), un arrêt de grande portée, dans lequel elle a estimé que la directive sur le retour s'oppose aux règles nationales prévoyant l’infliction d’une peine d’emprisonnement à un ressortissant d’un pays tiers en séjour irrégulier qui ne respecte pas un ordre de quitter le territoire national, parce qu'une telle sanction est susceptible de mettre en péril la réalisation de l'objectif visant à instaurer une politique efficace d'éloignement et de rapatriement qui respecte les droits fondamentaux.

The amendment is in accordance with the ECJ judgement in Joined Cases C-402/07 and C-432/07, Sturgeon vs Condor and Böck Lepuschitz vs Air France, which grants passengers, in case of long delays, i.e. of more than three hours, the same rights as passengers whose flights are cancelled.
Cet amendement est conforme à l'arrêt de la Cour de justice de l'Union européenne rendu dans les affaires jointes C-402/07 et C-432/07, Sturgeon contre Condor et Böck Lepuschitz contre Air France, qui accorde aux passagers, en cas de longs retards, c'est-à-dire plus de trois heures, les mêmes droits qu'aux passagers dont les vols ont été annulés.

Ø abolish all possible ‘opt-outs’ from the directive and fully implement the ECJ judgements (on-call time spent at the workplace must be regarded as working time, compensatory rest must be granted immediately after time spent on duty);
