I would remind the Council that the UN Working Party on these five Cuban citizens being held in the USA stated on 27 May 2005 that their trial was not carried out in a climate of ‘objectivity and impartiality’, and that the Atlanta 11 Circuit Appeals Court decided unanimously on 9 August 2005 to annul the sentence handed down in Miami.

Following the decision of 27 May 2005 of the UN working group concerning the five Cuban citizens imprisoned in the US, which stated that 'the trial did not take place in a climate of objectivity and impartiality', on 9 August 2005 the US Court of Appeals for the Eleventh Circuit, sitting in Atlanta, decided unanimously to overturn the Miami judgment and annul the convictions of the five, ordering a retrial.

The situation in which five Cuban citizens unjustly convicted and imprisoned in Miami find themselves, and the complete lack of contact between two of them and their close families amount to a serious violation of human rights by the U.S. Administration.
