Definition: This block contains a wide variety of disorders that differ in severity and clinical form but that are all attributable to the use of one or more psychoactive substances, which may or may not have been medically prescribed. The third character of the code identifies the substance involved, and the fourth character specifies the clinical state. 3. Member States shall take the necessary measures to ensure that, for the application of paragraphs 1 and 2 of this Article, information concerning the existence of criminal convictions for any of the offences referred to in Articles 3 to 7, or of any disqualification from exercising activities involving direct and regular contacts with children arising from those criminal convictions, is transmitted in accordance with the procedures set out in Council Framework Decision 2009/315/JHA of 26 February 2009 on the organisation and content of the exchange of information extracted from the criminal record between Member States (13) when requested under Article 6 of that Framework Decision with the consent of the person concerned.
3. In 2006 and 2007, the Commission presented a comprehensive legislative package consisting of three instruments: Council Framework Decision 2008/675/JHA obliging Member States to take account of previous convictions in new criminal proceedings; Council Framework Decision 2009/315/JHA on the organisation and content of the exchange of information extracted from criminal records; and Council Decision 2009/316/JHA establishing ECRIS as the technical means of exchanging information extracted from criminal records.[47] Due to be implemented by April 2012, Council Framework Decisions 2009/315/JHA and 2009/316/JHA aim to define the ways in which a convicting Member State must transmit information concerning a new conviction to the Member State(s) of the convicted person’s nationality, storage obligations, and a framework for a computerised system of information exchange.

The mechanism established by this Framework Decision aims at inter alia ensuring that a person convicted of a sexual offence against children should no longer, where the criminal record of that person in the convicting Member State contains such conviction and, if imposed and entered in the criminal record, a disqualification arising from it, be able to conceal this conviction or disqualification with a view to performing professional activity related to supervision of children in another Member State.

132.2 (1) Le Commissaire de la Gendarmerie royale du Canada maintient, dans le fichier automatisé des relevés de condamnations criminelles, un registre, distinct des autres dossiers criminels, comportant l'inscription des déclarations de culpabilité de personnes à une infraction sexuelle mettant en cause un enfant. Il consigne dans ce registre, pour chacune de ces déclarations de culpabilité, les renseignements suivants: a) le nom de la personne déclarée coupable d'une telle infraction et, le cas échéant, l'adresse de cette personne lorsqu'elle a été ainsi déclarée coupable; b) l'article du Code criminel en vertu duquel cette personne a été déclarée coupable d'une telle infraction; c) les détails sur la façon dont cette personne a commis l'infraction en cause; d) la date à laquelle la personne déclarée coupable d'une telle infraction sera libérée d'office en vertu d'une ordonnance de la Commission sous le régime de l'article 130 ou 131; e) tout autre renseignement prescrit par règlement (2) Sur demande, un agent de la paix qui procède à une enquête relative à une infraction sexuelle mettant en cause un enfant a le droit de se faire communiquer les renseignements consignés à un dossier versé au registre mentionné au paragraphe (1) (3) Lorsqu'une personne est déclarée coupable d'une infraction sexuelle mettant en cause un enfant, le corps de police chargé de l'enquête relative à cette infraction est tenu de fournir un dossier de l'infraction comportant les renseignements mentionnés aux alinéas (1)a), b), c) et e), pour qu'ils soient consignés au registre mentionné au paragraphe (1)».

1. Each Member State shall ensure that in the course of criminal proceedings against a person, previous convictions handed down against the same person for different facts in other Member States, in respect of which information has been obtained under applicable instruments on mutual legal assistance or on the exchange of information extracted from criminal records, are taken into account to the extent previous national convictions are taken into account, and that equivalent legal effects are attached to them as to previous national convictions, in accordance with national law.

Tout État membre fait en sorte que, à l’occasion d’une procédure pénale engagée contre une personne, des condamnations antérieures prononcées dans un autre État membre contre cette même personne pour des faits différents, pour lesquelles des informations ont été obtenues en vertu des instruments applicables en matière d’entraide judiciaire ou d’échange d’informations extraites des casiers judiciaires, soient prises en compte dans la mesure où des condamnations nationales antérieures le sont et où les effets juridiques attachés à ces condamnations sont équivalents à ceux qui sont attachés aux condamnations nationales antérieures conformément au droit interne.
