IN-CONTEXT TRANSLATIONS

(9) In any proceedings, a ticket endorsed under subsection (4), or a certificate setting out with reasonable particularity the conviction and sentence of an offender under this section signed by a person designated to receive payments made under subsection (1), is, on proof that the accused or defendant is the offender referred to in the ticket or certificate, evidence that the accused or defendant was convicted and sentenced under this section without proof of the signature or the official character of the person appearing to have endorsed the ticket or signed the certificate.

(2.1) In any summary conviction proceedings, where the name of a defendant is similar to the name of an offender referred to in a certificate made under subparagraph (1)(a)(i) or (ii) in respect of a summary conviction or referred to in a copy of a summary conviction mentioned in subsection (2), that similarity of name is, in the absence of evidence to the contrary, evidence that the defendant is the offender referred to in the certificate or the copy of the summary conviction.

(5) For the purpose of proving a conviction under subsection 99(3), a certificate containing the substance of the charge and conviction, purporting to be signed by the officer having the custody of the records of the court in which the offender was convicted, or by his deputy, shall, upon proof of the identity of the witness as the offender, be evidence of the conviction, without proof of the signature or of the offical character of the person appearing to have signed the certificate.
(5) Aux fins de prouver une condamnation aux termes du paragraphe 99(3), un certificat renfermant la substance de l’accusation et de la condamnation, censé avoir été signé par le fonctionnaire ayant la garde des archives de la cour dans laquelle le contrevenant a été condamné, ou par son adjoint, doit après qu’il a été démontré que le témoin est bien le contrevenant, constituer une preuve de la condamnation, sans qu’il soit besoin de prouver la signature ou le caractère officiel de la personne paraissant avoir signé le certificat.

Too often in the courts judges accept this defence, notwithstanding that the crown has put forward certificate evidence of the breathalyzer results, notwithstanding the report of the arresting officer who clearly gave testimony that the person arrested seemed to be incapable of performing some simple required tests, notwithstanding evidence which the average person would think was enough to convict.
