Regulation (EC) No 726/2004 creates a Union-wide marketing authorisation procedure for certain categories of medicinal products (the ‘centralised procedure’), lays down rules for the pharmacovigilance of those products and establishes the European Medicines Agency (the ‘Agency’).

The area within which enhanced cooperation would take place, the establishment of measures for the creation of a unitary patent providing protection throughout the Union and the setting-up of centralised Union-wide authorisation, coordination and supervision arrangements, is identified by Article 118 TFEU as one of the areas covered by the Treaties.

Points out that the Treaty of Lisbon includes a new legal basis providing for codecision in respect of intellectual property rights, in that Article 118 of the Treaty on the Functioning of the European Union (TFEU) provides: 'In the context of the establishment and functioning of the internal market, the European Parliament and the Council, acting in accordance with the ordinary legislative procedure, shall establish measures for the creation of European intellectual property rights to provide uniform protection of intellectual property rights throughout the Union and for the setting up of centralised Union-wide authorisation, coordination and supervision arrangements'; deplores the fact that unanimity and mere consultation of Parliament have been retained as the decision-making procedure as regards the language arrangements with regard to intellectual property rights;
4. relève que le traité de Lisbonne comprend une nouvelle base juridique prévoyant la codécision pour les droits de propriété intellectuelle dans la mesure où l'article 118 du traité sur le fonctionnement de l'Union européenne (TFUE) dispose: "Dans le cadre de l'établissement ou du fonctionnement du marché intérieur, le Parlement européen et le Conseil, statuant conformément à la procédure législative ordinaire, établissent les mesures relatives à la création de titres européens pour assurer une protection uniforme des droits de propriété intellectuelle dans l'Union, et à la mise en place de régimes d'autorisation, de coordination et de contrôle centralisés au niveau de l'Union"; déplore le fait que l'unanimité et la simple consultation du Parlement aient été retenues en tant que procédure décisionnelle en ce qui concerne le régime linguistique en liaison avec les droits de propriété intellectuelle;

In the context of the establishment and functioning of the internal market, the European Parliament and the Council, acting in accordance with the ordinary legislative procedure, shall establish measures for the creation of European intellectual property rights to provide uniform protection of intellectual property rights throughout the Union and for the setting up of centralised Union-wide authorisation, coordination and supervision arrangements.
