38 (1) If an overpayment has been made by an employee on account of the employee’s contribution under this Act for a year, the Minister must, if application in writing is made to the Minister by the employee not later than four years — or, in the case of an employee who, in respect of a disability pension, is notified after September 1, 2010 of a decision under subsection 60(7) or 81(2), a decision under subsection 82(11) or 83(11) as those subsections read immediately before their repeal or a decision under section 54 or 59 of the Department of Employment and Social Development Act, 10 years — after the end of the year, refund to the employee the amount of the overpayment.

For greater certainty, payments of allowances made before the coming into force of this Act to judges of the Supreme Court of the Yukon Territory and the Supreme Court of the Northwest Territories under subsection 27(2) of the Judges Act and to judges of the Federal Court under subsection 27(3) of that Act, as those subsections read immediately before the coming into force of this Act, are authorized.
7. ‘public undertakings operating in the manufacturing sector’ means all undertakings whose principal area of activity, defined as being at least 50 % of total annual turnover, is in manufacturing. These undertakings are those whose operations fall under Section D — Manufacturing being subsection DA up to and including subsection DN of the NACE (Rev.1) classification (5);

2. Measures proposed under this subsection in areas classified as high or medium forest fire risk within the framework of the Community action on protection of forests against fires shall conform to the forest protection plans established by the Member States for those areas.

During the same period the Member States which have introduced the Directive shall accept those prepackages coming from Member States benefiting from the derogation provided for in paragraph 2 of this Article which comply with the provisions of Annex I. 1 and Annex III to the Directive, even if they do not bear the EEC mark referred to in subsection 3.3 of Annex I, on the same basis and under the same conditions as those prepackages which comply with all the provisions of the Directive.
4. Pendant cette même période, les États membres ayant mis en vigueur la directive accepteront les préemballages provenant des États membres bénéficiant de la dérogation prévue au paragraphe 2 qui sont conformes aux dispositions de l'annexe I point 1 et de l'annexe III de la directive, même s'ils ne portent pas le signe CEE prévu au point 3.3 de l'annexe I, au même titre et dans les mêmes conditions que les préemballages conformes à toutes les dispositions de la directive.
