54 (1) Where a former member who is in receipt of an allowance subsequently becomes a member and payment of that allowance ceases, any supplementary benefit payable to that person after that person ceases to be a member shall be at least equal to the supplementary benefit that the former member would have received if that person had not subsequently become a member.

6. Where a special allowance ceases to be payable in respect of a child for a reason referred to in paragraph 4(4)(a), (b) or (c), the chief executive officer of the department, agency or institution that made the application under paragraph 4(1)(a) in respect of the child shall, as soon as possible after the special allowance ceases to be payable in respect of the child, notify the Minister in the prescribed form and manner.

(2) Where a member of the forces who has been awarded an attendance allowance under subsection (1) is in or enters a hospital under the jurisdiction of the Department, the Minister may, unless that member is in receipt of an attendance allowance at the maximum rate payable under that subsection or is blind, direct that payment of the allowance cease during the period that the member is in hospital, commencing with the later of the time the direction is made and one month after the end of the month in which the member entered hospital.

To ensure that no emission allowances are allocated free of charge to an installation that has ceased its operations, this Decision should provide for measures defining such installations and prohibiting the issuance of allowances, unless it can be established that the installation will resume its operations within a specified and reasonable amount of time.

An installation is deemed to have partially ceased operations, provided that one sub-installation, which contributes to at least 30 % of the installation’s final annual amount of emission allowances allocated free of charge or to the allocation of more than 50 000 allowances, reduces its activity level in a given calendar year by at least 50 % compared to the activity level used for calculating the sub-installation’s allocation in accordance with Article 9 or, where applicable, with Article 18 (hereinafter ‘initial activity level’).
