IN-CONTEXT TRANSLATIONS

(49) In order to ensure uniform conditions for the implementation of this Regulation as regards exports and certain general provisions, implementing powers should also be conferred on the Commission in respect of measures on the treatment of refund certificates by the Member States and the exchange of information and the specific administrative assistance between the Member States as regards the refund certificates, measures on the fixing of the global amount allocated to small exporters and the individual threshold of exemption from the presentation of refund certificates, measures on the issuing of replacement refund certificates and duplicate refund certificates, measures limiting the amounts for which refund certificates may be issued, rejecting amounts applied for in respect of those certificates and suspending the lodging of applications for refund certificates where amounts that exceed available amounts fixed on the basis of the commitments resulting from international agreements, are applied for, necessary procedural rules and technical criteria for the application of other measures with regard of exports, measures on fixing the applicable duty in case of direct offsetting in preferential trade and the related amounts payable on exports to the country or region concerned, measures ensuring that processed agricultural products declared for export under a preferential trade agreement are not in fact exported under a non- preferential agreement or vice versa , measures concerning the methods of qualitative and quantitative analysis of processed agricultural products and non-Annex I goods, the technical provisions necessary for their identification and the procedures for the purpose of their classification in the Combined Nomenclature.
(49) Afin d'assurer des conditions uniformes d'exécution du présent règlement en ce qui concerne les exportations et certaines dispositions générales, il convient de conférer des compétences d'exécution à la Commission en vue d'adopter des mesures sur le traitement des certificats de restitution à l'exportation par les États membres et l'échange d'informations et l'assistance administrative spécifique entre les États membres, des mesures concernant la fixation du montant global alloué aux petits exportateurs et le seuil d'exemption individuel pour la présentation de certificats de restitution, des mesures sur la délivrance de certificats de restitution de remplacement et de duplicatas de certificats de restitution, des mesures limitant le montant pour lequel des certificats de restitution peuvent être délivrés, rejetant des montants demandés pour ces certificats et suspendant l'introduction de demandes de certificats de restitution lorsque des montants supérieurs aux montants disponibles fixés sur la base des engagements résultant des accords internationaux conclus sont demandés, les règles procédurales et les critères techniques nécessaires à l'application d'autres mesures concernant les exportations, des mesures fixant le droit applicable en cas de compensation directe dans les échanges préférentiels et les montants liés à payer sur les exportations vers le pays ou la région concerné, des mesures assurant que les produits agricoles transformés déclarés pour exportation au titre d'un accord commercial préférentiel ne sont pas exportés au titre d'un accord non-préférentiel ou vice-versa , des mesures concernant les méthodes d'analyse qualitative et quantitative des produits agricoles transformés et des marchandises hors annexe I, les dispositions techniques nécessaires pour leur identification et les procédures à appliquer aux fins de leur classification, dans la Nomenclature combinée.

(27) In order to take account of the specific manufacturing processes and trading requirements of non-Annex I goods incorporating certain agricultural products, the power to adopt acts in accordance with Article 290 TFEU should be delegated to the Commission concerning rules on the characteristics of the non-Annex I goods to be exported and of the agricultural products used for their manufacture, rules on the determination of the export refunds for certain agricultural products exported after processing into non-Annex I goods, rules on the evidence needed to prove the composition of the exported non-Annex I goods, rules requiring a declaration of the use of certain imported agricultural products, rules on the assimilation of agricultural products to basic products and on the determination of the reference quantity of each of the basic products, and the application of horizontal rules on export refunds for agricultural products to non-Annex I goods.
(27) Afin de tenir compte des processus de fabrication et des exigences commerciales spécifiques des marchandises hors annexe I incorporant certains produits agricoles, il convient de déléguer à la Commission le pouvoir d'adopter des actes conformément à l'article 290 du traité portant sur des règles relatives aux caractéristiques des marchandises hors annexe I destinées à être exportées et des produits agricoles utilisés pour leur fabrication, des règles relatives à la détermination des restitutions à l'exportation pour certains produits agricoles exportés après transformation en marchandises hors annexe I, des règles concernant les éléments nécessaires pour prouver la composition des marchandises hors annexe I exportées, des règles posant l'exigence d'une déclaration de l'utilisation de certains produits agricoles importés, des règles concernant l'assimilation de produits agricoles à des produits de base et la détermination de la quantité de référence de chacun des produits de base, et l'application, aux marchandises hors annexe I, des règles horizontales relatives aux restitutions à l'exportation pour les produits agricoles.

(47) In order to ensure uniform conditions for the implementation of this Regulation as regards exports, implementing powers should be conferred on the Commission in respect of measures on the application of refund rates, on the calculation of the export refunds, on the assimilation of certain products to basic products and the determination of the reference quantity of basic products, on the application for, the issuing of and the management of certificates for the export of certain non-Annex I goods to certain destinations when provided for in an international agreement concluded or provisionally applied by the Union in accordance with the TFEU and on the treatment of disappearances of products and quantity losses during the manufacturing process and the treatment of by-products.
(47) Afin d'assurer des conditions uniformes d'exécution du présent règlement en ce qui concerne les exportations, il convient de conférer des compétences d'exécution à la Commission en vue d'adopter des mesures concernant l'application des taux de restitution, le calcul des restitutions à l'exportation, l'assimilation de certains produits à des produits de base et la détermination de la quantité de référence de produits de base, la demande, la délivrance et la gestion des certificats pour l'exportation de certaines marchandises hors annexe I vers certaines destinations lorsque cela est prévu dans un accord international conclu ou appliqué à titre provisoire par l'Union conformément au traité sur le fonctionnement de l'Union européenne, ainsi que le traitement des disparitions de produits et des pertes de quantités durant le processus de fabrication et le traitement des sous-produits.

1. Export refunds on agricultural products incorporated in non-Annex I goods shall be granted where an application for export refunds has been submitted and a refund certificate which was valid at the time of export, is presented.
