(a) if a re-determination or further re-determination is made by the President under subparagraph 61(1)(a)(iii) and a portion of the amount refunded as a result of that decision is owing as duties and interest, pay interest at the prescribed rate for the period beginning on the first day after the day the refund is given and ending on the day the amount of the refund found to be owing as duties and interest has been paid in full, calculated on the outstanding balance of that amount of the refund, except that if the amount of the refund found to be owing is paid within thirty days after the day that decision is made, interest shall not be payable on that amount from that day to the day the amount is paid; or
a) dans le cas où, à la suite d’une révision ou d’un réexamen effectué par le président en vertu du sous-alinéa 61(1)a)(iii), une fraction de la somme remboursée devient due à titre de droits et d’intérêts, paie des intérêts au taux réglementaire, calculés sur les arriérés pour la période commençant le lendemain de l’octroi du remboursement et se terminant le jour du paiement intégral de la fraction due; toutefois, nul intérêt n’est payable sur les arriérés pour la période allant de la révision ou du réexamen jusqu’au versement de la fraction due si celle-ci est versée dans les trente jours suivant la révision ou le réexamen;

(2.2) Subsection 164(2) does not apply to a refund to be made to a taxpayer and arising because of section 122.61 except to the extent that the taxpayer’s liability referred to in that subsection arose from the operation of paragraph 160.1(1)(a) with respect to an amount refunded to the taxpayer in excess of the amount to which the taxpayer was entitled because of section 122.61.
