whereas the disclosure of information related to the prudential supervision of credit institutions is not at the free disposal of the ECB but subject to limits and conditions as established by relevant Union law to which both Parliament and the ECB are subject; whereas pursuant to Article 37.2 of the Statute of the European System of Central Banks and of the ECB (the ‘Statute of the ESCB’), persons having access to data covered by Union legislation imposing an obligation of secrecy are subject to such Union legislation.

However, those conditions shall not prevent ESMA, the competent authorities or the relevant central banks from exchanging or transmitting confidential information in accordance with this Regulation and with other legislation applicable to investment firms, credit institutions, pension funds, UCITS, AIFMs, insurance and reinsurance intermediaries, insurance undertakings, regulated markets or market operators or otherwise with the consent of the competent authority or other authority or body or natural or legal person that communicated the information.
Toutefois, ces exigences n'empêchent pas l'AEMF, les autorités compétentes ou les banques centrales concernées d'échanger ou de transmettre des informations confidentielles conformément au présent règlement et aux autres actes législatifs applicables notamment aux entreprises d'investissement, aux établissements de crédit, aux fonds de pension, aux OPCVM, aux gestionnaires de fonds d'investissement alternatifs, aux intermédiaires d'assurance et de réassurance, aux entreprises d'assurance, aux marchés réglementés ou aux opérateurs de marchés, avec l'accord de l'autorité compétente, d'une autre autorité, d'un autre organisme ou d'une autre personne physique ou morale qui a communiqué ces informations.
