‘4a. The ESCB may transmit confidential statistical information to authorities or bodies of the Member States and the Union responsible for the supervision of financial institutions, markets and infrastructures or for the stability of the financial system in accordance with Union or national law, and to the European Stability Mechanism (ESM), only to the extent and at the level of detail necessary for the performance of their respective tasks.

The Rapporteur considers that such significant empowerment to transmit confidential data to a number of authorities needs to be balanced by a requirement of the receiving authorities to take all necessary regulatory, administrative, technical and organisational measures to ensure the physical and logical protection of the confidential statistical information concerned.

Nevertheless, this Article shall not prevent the competent authorities from exchanging or transmitting confidential information in accordance with this Directive or with Regulation (EU) No/2014 * and with other Directives or Regulations applicable to investment firms, credit institutions, pension funds, UCITS, AIFs, insurance and reinsurance intermediaries, insurance undertakings, regulated markets or market operators, CCPs, CSDs , or otherwise with the consent of the competent authority or other authority or body or natural or legal person that communicated the information.

8. Regards the main new provision introduced by this kind of ‘second-generation agreement’, i.e. the possibility for the Commission and the Swiss Competition Commission to exchange confidential information, as a positive step; believes that this agreement could be considered a model for future bilateral cooperation agreements in the area of competition enforcement where there is a high degree of similarity between the parties to the agreement as regards their substantive competition rules, investigative powers and applicable sanctions; is of the opinion that the EU should adopt a general framework establishing a minimum common and consistent basis for any future negotiations on competition enforcement cooperation, leaving to the Commission, however, a margin for manoeuvre to allow for more ambitious achievements on a case-by-case basis; notes that this framework should include rules on secure channels for transmitting confidential information;
8. estime que la nouvelle disposition la plus importante introduite par ce type d'«accord de seconde génération», à savoir la possibilité pour la Commission européenne et la Commission de la concurrence suisse d'échanger des informations confidentielles, représente une avancée positive; est convaincu que cet accord pourrait être considéré comme un modèle pour de futurs accords bilatéraux de coopération en matière d'application des règles de concurrence, dès lors qu'il existe un degré élevé de similitude entre les parties à l'accord en ce qui concerne leurs règles de fond en matière de concurrence, leurs pouvoirs d'enquête et les sanctions applicables; est d'avis que l'Union européenne devrait adopter un cadre général établissant une base commune minimale et cohérente pour des négociations futures sur la coopération en matière d'application des règles de concurrence, en laissant toutefois une marge de manœuvre à la Commission pour lui permettre d'atteindre des objectifs plus ambitieux, le cas échéant; relève que ce cadre devrait inclure des règles relatives à des canaux sûrs pour la transmission des informations confidentielles;

Paragraph 1 shall not prevent the competent authorities from exchanging confidential information or from transmitting confidential information to ESMA or the European Systemic Risk Board, subject to constraints relating to firm-specific information and effects on third countries as provided for in Regulation (EU) No ./2010 [ESMA] and Regulation (EU) No ./2010 [ESRB] respectively .

Le paragraphe 1 n'empêche pas les autorités compétentes d'échanger des informations confidentielles ou de les transmettre à l“AEMF ou au Comité européen du risque systémique, sous réserve d'obligations en rapport avec l'information spécifique aux entreprises et les effets sur les pays tiers, comme prévu dans le règlement (UE) n° ./2010 [AEMF] et le règlement (UE) n° ./2010 [CERS] respectivement.

Paragraph 1 shall not prevent the competent authorities from exchanging confidential information or from transmitting confidential information to ESMA or the European Systemic Risk Board (hereinafter the “ESRB”), subject to constraints relating to firm-specific information and effects on third countries as provided for in Regulation (EU) No 1095/2010 and Regulation (EU) No 1092/2010 of the European Parliament and of the Council of 24 November 2010 on European Union macro-prudential oversight of the financial system and establishing a European Systemic Risk Board (27) respectively.
