Het voorziene voorbehoud was letterlijk als volgt geformuleerd : « Contracting States may reserve the right not to return the child when such return would be manifestly incompatible with the fundamental principles of the law relating to the family and children in the State addressed » (15). Door deze tekst aan te nemen, opende men een diepe kloof in de consensus die tot dan toe op fundamentele wijze de werkzaamheden van de Conventie had beheerst; daarom, in het besef dat men een ruimschoots aanvaardbare oplossing moest vinden, zijn alle delegaties deze weg ingeslagen, die de zekerste waarborg bood voor het welslagen van de Conventie.

Een auteur van het tweede amendement verwijst naar het advies van de Raad van State bij dit artikel, waarin ernstige reserves worden geformuleerd bij de machtiging aan de Koning om zonder enige indicatie of beperking een bepaald percentage van de B.T.W. voor de alternatieve financiering van de sociale zekerheid te bestemmen.
Un des auteurs du deuxième amendement renvoie à l'avis du Conseil d'État sur le présent article, dans lequel il formule d'importantes réserves à propos de la disposition habilitant le Roi, sans autre indication ou limitation, à affecter un certain pourcentage de la T.V. A. au financement alternatif de la sécurité sociale.
