The compromise involved the following: - the percentage of optional set-aside to be deducted for the purpose of calculating the possible application of special set-aside is fixed at 85%; - the Commission will authorize the Member States to use the provision concerning special set-aside as from 1996 provided that the Member State concerned provides it with detailed information on the areas voluntarily set aside for the 1995 harvest; - the Commission will be authorized to grant derogations in connection with the special set-aside where the base areas are exceeded because of exceptional weather which has caused average yields to fall to a level far below normal; - in view of the exceptional market situation, the special set-aside of less than 1% will not be applied in 1996; - as regards the possibility open to the Member States of applying single national base areas with, however, the option of concentrating any penalties for exceeding those areas wholly or partially on the regions/base areas responsible for exceeding them, the Council took note of the Commission's intention of making an appropriate proposal within two months and it undertook to decide within a month of receiving the European Parliament's Opinion; - the Council also noted the Commission's intention of submitting to it, at the earliest opportunity, a proposal concerning durum wheat-production rights.
