Each Member State should be able to choose the measures and instruments which it wishes to adopt in order to reduce excessive fishing capacity.

Si la Commission a interdit les activités de pêche en raison de l’épuisement présumé des possibilités de pêche dont dispose un État membre ou un groupe d’États membres, ou la Communauté, et qu’il apparaît qu’en fait, un État membre n’a pas épuisé ses possibilités de pêche, le présent article s’applique.
1. When the Commission has prohibited fishing because of the alleged exhaustion of the fishing opportunities available to a Member State or group of Member States or to the Community and it transpires that a Member State has not in fact exhausted its fishing opportunities, this Article shall apply.

They shall ensure that fishing vessels flying their flag are present in a geographical area subject to a fishing effort regime when carrying on board or, where appropriate, deploying a fishing gear or gears subject to that fishing effort regime or, where appropriate, operating in a fishery subject to that fishing effort regime only if the maximum allowable fishing effort available to them has not been reached and if the effort available to the individual fishing vessel has not been exhausted.

2. À compter de la date visée au paragraphe 1, l’État membre concerné interdit la pêche pratiquée soit pour le stock ou le groupe de stocks dont le quota a été épuisé dans la pêcherie concernée soit par une partie ou la totalité des navires de pêche battant son pavillon lorsqu’ils détiennent à bord l’engin de pêche en question dans la zone géographique où l’effort de pêche maximal autorisé a été atteint, ainsi qu’en particulier la conservation à bord, le transbordement, le déplacement et le débarquement de poissons pêchés après cette date, et fixe une date jusqu’à laquelle les transbordements, les transferts et les débarquements ou les déclarations définitives de captures sont autorisés.
2. As from the date referred to in paragraph 1, the Member State concerned shall prohibit fishing either for the stock or group of stocks whose quota has been exhausted, in the relevant fishery or when carrying on board the relevant fishing gear in the geographical area where the maximum allowable fishing effort has been reached, by all or part of the fishing vessels flying its flag and in particular the retention on board, the transhipments, the relocations and the landings of fish taken after that date and shall decide on a date up to which transhipments, transfers and landings or final declarations of catches are permitted.

When the Commission has halted fishing because of the alleged exhaustion of the fishing opportunities available to a Member State or group of Member States, or to the Community and it transpires that a Member State has not in fact exhausted its fishing opportunities, the following paragraphs shall apply.
