In order to ensure a level playing field, it should also be possible to exclude joint venture companies from the scope of this Directive if they are jointly held by local energy utilities or operators falling within point (f) of Article 3 of Directive 2003/87/EC who do not provide any services other than investment services for local energy utilities or operators falling within point (f) of Article 3 of Directive 2003/87/EC, and provided that those local energy utilities or those operators will be exempt under point (j) of Article 2(1) should they carry out those investment services themselves.

Afin de tenir compte du cas où le rapport d’évaluation visé au paragraphe 2 conclut que les actions spécifiques décrites à l’annexe I n’ont pas été mises en œuvre au plus tard le 31 décembre 2016 et ne peuvent être mises en œuvre avant l’échéance du programme, même si lesdites actions spécifiques ne sont plus pertinentes pour la réalisation des objectifs énoncés aux articles 2 et 3, la Commission est habilitée à adopter des actes délégués en conformité avec l’article 15 pour modifier l’annexe I en supprimant les actions spécifiques concernées.
3. For the purposes of taking into account the situation whereby the evaluation report under paragraph 2 concludes that the specific actions set out in Annex I have not been implemented by 31 December 2016 and cannot be implemented by the end of the Programme, including when those specific actions are no longer relevant for the achievement of the objectives set out in Articles 2 and 3, the Commission shall be empowered to adopt delegated acts in accordance with Article 15 to amend Annex I by removing the specific actions concerned.
