The aid measures implemented by Belgium in the contract of 6 November 2001 concluded between the Walloon Region and Ryanair, in the form of a reduction in airport landing charges that goes beyond the official tariff set in Article 3 of the Walloon Government Decree of 16 July 1998 laying down charges to be levied for the use of airports in the Walloon Region, and the general discounts provided for in Article 7(1) and (2) of the said Decree, are incompatible with the common market within the meaning of Article 87(1) of the Treaty.

In their written replies, Belgium and Ryanair pointed out that the date of signature of the agreements between Ryanair, BSCA and the Walloon Region (November 2001) was simply the formalisation of an agreement reached in February 2001 (Ryanair) or April 2001 (Belgium).

(FR) The Commission investigation that opened on 11 December 2002, in accordance with Treaty requirements, is intended to determine whether the advantages that the Region of Wallonia and the airport operator (BSCA) conferred on Ryanair when it moved into Charleroi in April 2001 (rebates on landing fees, defraying Ryanair staff costs, defraying marketing costs, financial incentives each time a new route is opened, etc.) are equivalent or not to state aid and, if they are, whether these advantages are compatible with the common market or whether on the other hand they constitute distortions of competition to the disadvantage of other operators, whether these are other airlines or other airports.
