(5) Lorsqu’un contributeur, qui a choisi, sous le régime de la Loi ou de la partie V de l’ancienne loi, de contribuer à l’égard de toute période de service et qui a entrepris de contribuer pour ce service au moyen de mensualités, cesse d’être membre des forces régulières avant d’avoir acquitté tous les versements requis, les versements impayés doivent être retenus comme il suit des prestations qui lui sont payables :
(5) Where a contributor, who has elected under the Act or Part V of the former Act to pay for any period of service and has undertaken to pay for that period by instalments, ceases to be a member of the regular force before all the instalments have been paid, the unpaid instalments shall be reserved from the benefits payable to him as follows:

(5) Si une personne possédant les qualités requises pour recevoir le versement intégral ou partiel d’une gratification prévue au présent article décède avant que le versement en ait été effectué, ou avant que le versement en ait été effectué intégralement, la gratification ou la fraction de gratification qui lui est payable, ou tout solde impayé de gratification, ne doivent pas être versés à la succession de cette personne, mais doivent l’être à toute autre personne pouvant y avoir droit en conformité de la présente loi, et, à défaut d’autre ayant droit, font partie de la succession militaire du membre décédé et y sont compris, en conformité du paragraphe (4).
(5) Where a person who was qualified to receive payment of a gratuity or any part thereof under this section dies before payment thereof or before payment thereof in full the gratuity or that part thereof payable to him or any unpaid balance thereof shall not be paid to the estate of such person but shall be paid to such other person as may be entitled thereto in accordance with this Act and if no other person is so entitled, shall form part of and be comprised in the deceased member’s service estate in accordance with subsection (4).
