rappelle que, dans un grand nombre de navires ne battant pas pavillon d'un État membre de l'Union qui font escale dans les ports européens, l'équipage est en grande majorité philippin et que bon nombre de ces marins travaillent dans des conditions extrêmement dures et inhumaines, et demande dès lors aux États membres de ne pas autoriser l'accueil, dans les ports européens, de ces navires dans lesquels les conditions de travail sont contraires aux droits des travailleurs et aux principes consacrés par la charte des droits fondamentaux de l'Union européenne; demande également que les navires ne battant pas pavillon d'un État membre de l'Union garantissent à leurs équipages les conditions de travail prévues par le droit international et les normes fixées par l'Organisation internationale du travail et l'Organisation maritime internationale.
Bearing in mind that the majority of the crew on many non-Community flagged vessels calling at European ports are Filipino, as well as the harsh and inhuman working conditions in which many of these seafarers live, calls on Member States not to allow these vessels to be received in European ports when the working conditions on board contravene the labour rights and principles enshrined in the Charter of Fundamental Rights of the European Union; urges, likewise, non-Community flagged vessels to guarantee their crews’ working conditions in accordance with international legislation and the rules laid down by the ILO and the IMO.

The EESC notes that the third recital of the preamble, and specifically Article 151 of the TFEU, are intended to promote improved living and working conditions ‘so as to make possible their harmonisation while the improvement is being maintained’ and expressly calls for a ‘Social Progress Protocol’ to be included in the Treaties in order to enshrine the principle of the equal value of fundamental social rights and economic freedoms and thereby make it clear that neither economic freedoms nor competition rules should be allowed to take precedence over fundamental social rights, and also to clearly define the impact of the Union's objective of achieving social progress (1).

The review shall concern the questions whether – having regard to the case-law of the Court of Justice relating to the entitlement to paid annual leave as a principle of European Union social law, which is also expressly affirmed in Article 31(2) of the Charter of Fundamental Rights of the European Union and is covered in particular by Directive 2003/88/EC of the European Parliament and of the Council of 4 November 2003 concerning certain aspects of the organisation of working time (OJ 2003 L 299, p. 9) – the judgment of the General Court of the European Union of 8 November 2012 in Case T 268/11 P Commission v Strack affects the unity or consistency of European Union law inasmuch as the General Court, as an appeal court:

62. tient à ce que la Commission s'engage davantage, dans la mise en œuvre du second cycle du régime des préférences généralisées de la Communauté (SPG), à promouvoir et à garantir en collaboration avec les pays bénéficiaires l'application effective dans les pays destinataires du régime SPG + des droits humains de base et des droits du travail fondamentaux consacrés par les conventions des Nations unies et de l'Organisation internationale du travail, ainsi que des conventions relatives à l'environnement et aux principes de bonne gouvernance; estime que, d'une manière générale, l'octroi de droits préférentiels d'accès à des pays qui ne respectent pas les droits humains, les conventions internationales sur le droit du travail et les accords en matière d'environnement tend à dissuader les pays en question de se conformer aux règles de l'OIT et des Nations unies;
62. Insists that, in the implementation of the second cycle of the Community's Generalised System of Preferences (GSP) scheme, the Commission should, in cooperation with beneficiary countries, strengthen its commitment to promoting and ensuring effective implementation of the core human and labour rights enshrined in UN/ILO Conventions in GSP+ beneficiary countries, as well as the Conventions related to environment and governance principles; believes that, as a general rule, granting preferential access to countries which do not respect human rights, international labour conventions and environmental agreements tends to weaken the incentive for countries to respect ILO and UN rules;
