As a consequence of the entry into force of the Treaty of Lisbon on 1 December 2009, the European Union has replaced and succeeded the European Community and from that date exercises all rights and assumes all obligations of the European Community. 1. estime que le traité de Lisbonne et la reconnaissance du caractère juridiquement contraignant de la charte des droits fondamentaux de l'Union européenne ont apporté d'importantes améliorations et renforcé la base constitutionnelle des institutions européennes et des États membres pour atteindre l'objectif d'instituer un espace de liberté, de sécurité et de justice, mais fait observer que certains domaines demandent des efforts supplémentaires, notamment en termes de mise en œuvre; considère que, pour que cet objectif soit atteint, les traités et le droit dérivé doivent être appliqués de manière uniforme dans toute l'Union; estime, dans ces conditions, que les dérogations et les régimes spéciaux devraient être évités et, dans la mesure du possible, disparaître; demande que la Commission et la présidence du Conseil respectent mieux l'obligation qui leur incombe d'informer directement et pleinement le Parlement européen à toutes les étapes de la procédure conduisant à la conclusion d'accords internationaux; regrette les retards dans l'alignement des actes relevant de l'ancien troisième pilier sur la nouvelle hiérarchie des normes (actes de base, actes délégués et actes d'exécution) prévue par le traité de Lisbonne et sur la nouvelle structure institutionnelle;
1. Believes that the Treaty of Lisbon and the recognition of the legally binding force of the Charter of Fundamental Rights of the European Union have brought significant improvements and strengthened the constitutional basis for the EU institutions and the Member States to achieve the objective of establishing an area of freedom, security and justice, but observes that some areas require additional efforts, in particular as regards their implementation; considers that this objective requires the Treaties and secondary law to be applied evenly throughout the EU; agrees, therefore, that opt-outs or special regimes should be avoided, and where possible removed; requests that the Commission and the Council Presidency better fulfil their obligation to inform Parliament ‘immediately and fully at all stages of the procedure’ leading to the conclusion of international agreements; regrets the delays in bringing the acts of the former third pillar into line with the new hierarchy of norms – basic, delegated and implementing acts – in accordance with the Treaty of Lisbon and the new institutional structure;

6. renouvelle son invitation au Conseil européen à clarifier en temps voulu et avant les élections la manière dont il prendra en compte les élections au Parlement européen et respectera le choix des citoyens dans sa proposition de candidat à la fonction de président de la Commission, et, ce, dans le cadre des consultations à organiser entre le Parlement et le Conseil européen, conformément à la déclaration 11 annexée au traité de Lisbonne; renouvelle, dans ce contexte, son invitation au Conseil européen à convenir avec le Parlement des modalités des consultations visées à l'article 17, paragraphe 7, du traité UE et à garantir le bon déroulement du processus conduisant à l'élection du président de la Commission européenne, conformément à la déclaration 11 ad article 17, paragraphes 6 et 7, du traité sur l'Union européenne;
6. Reiterates its invitation to the European Council to clarify, in a timely manner and before the elections, how it will take account of the elections to the European Parliament and honour the citizens’ choice when putting forward a candidate for President of the Commission, in the framework of consultations to be conducted between Parliament and the European Council under Declaration 11 annexed to the Treaty of Lisbon; in this context, renews its call on the European Council to agree with the European Parliament the arrangements for the consultations referred to in Article 17(7) TEU and to guarantee the smooth functioning of the process leading to the election of the President of the European Commission, as provided for in Declaration 11 on Article 17(6) and 17(7) of the Treaty on European Union;

Emphasises the role of the FRA in the continued observance of the fundamental rights situation within the Union and the implications of the Treaty of Lisbon in this field, by providing analysis, assistance and expertise, a task which requires quality, objectivity, effective impartiality and transparency; calls on the Commission to review and strengthen the mandate of the FRA in order to align its work with the new requirements based on the Treaty of Lisbon and the Charter; points out that, within the reviewed mandate, the monitoring role of the FRA should extend to the acceding countries; therefore adequate resources are needed for the increased tasks following the implementation of the Charter; reiterates its request to be fully associated in revising the multi-annual programme of the FRA; welcomes the inclusion of an Annex in the FRA’s Annual report, indicating the ratification by Member States of international human rights instruments;

se félicite par ailleurs des nouvelles obligations introduites par le traité de Lisbonne en ce qui concerne la lutte contre l’exclusion sociale et la discrimination ainsi que la promotion de la justice et de la protection sociale, l’égalité entre hommes et femmes, le respect de la vie privée et familiale, la solidarité entre les générations et la protection des droits de l’enfant, une politique commune d'asile et d'immigration, la lutte contre le trafic des êtres humains ainsi que les références explicites, contenues dans le traité, aux personnes faisant partie de minorités, laquelle reflète une autre valeur fondamentale de l’Union; se félicite en outre de ce que l’Union a acquis la personnalité juridique, ce qui lui permet d’adhérer à des traités internationaux, de l’amélioration de la protection juridictionnelle à travers l’extension de la juridiction de la Cour à des domaines incontestablement importants sous l’angle de la protection des droits fondamentaux, par exemple la coopération policière et judiciaire dans le domaine du droit pénal, le rôle renforcé du Parlement européen et des parlements nationaux dans le processus décisionnel européen, en particulier par l’évaluation de la mise en œuvre de la politique de l’UE dans l’espace de liberté, de sécurité et de justice et le rôle accru des citoyens européens, désormais habilités à réclamer une mesure législative de l’UE à travers l’initiative citoyenne, ainsi que de l'obligation d'entretenir un dialogue ouvert, transparent et régulier avec des associations représentatives et la société civile (article 11, paragraphe 2, du traité UE);
Welcomes, furthermore, the new horizontal obligations created by the Treaty of Lisbon to combat social exclusion and discrimination and to promote social justice and protection, equality between men and women, respect for private and family life, solidarity between generations and protection of the rights of the child, and to develop a common policy on asylum and immigration and combat trafficking in human beings, as well as its explicit reference to persons belonging to minorities, which reflects another founding value of the Union; welcomes the fact that the Union has acquired legal personality allowing it to accede to international treaties, the improvement in judicial protection with the extension of the jurisdiction of the CJ to areas of obvious relevance to the protection of fundamental rights, such as police and judicial cooperation in the field of criminal law, the strengthened role of the European Parliament and national parliaments in the European decision-making process, especially in evaluating the implementation of EU policy in the AFSJ, the increased role of European citizens, now invested with the power to initiate EU legislation through the European Citizens’ Initiative, and the obligation to maintain an open, transparent and regular dialogue with representative associations and civil society (Article 11(2) TEU);

se félicite que le traité de Lisbonne permette à un million de citoyens de l'Union de différents États membres collectivement d'inviter la Commission à présenter des propositions législatives, et est convaincu qu'un tel droit sensibilisera davantage les Européens à la citoyenneté de l'Union; rappelle que la transparence et la participation démocratique doivent être assurées par différentes formes de partenariat entre l'Union et les États membres, les institutions locales et régionales, les partenaires sociaux et la société civile; demande à la Commission de préparer des procédures transparentes et facilement compréhensibles mettant en œuvre l'«initiative de citoyenneté», de sorte que les citoyens de l'Union soient en mesure d'user effectivement de leur droit d'initiative en matière législative immédiatement après l'entrée en vigueur du traité de Lisbonne; bien qu'il espère que cela ne sera pas nécessaire, souligne que la Commission devrait introduire ce droit d'initiative dans ses politiques indépendamment du statut définitif du traité;
Welcomes the fact that the Treaty of Lisbon makes it possible for one million Union citizens from different Member States collectively to invite the Commission to submit legislative proposals, and believes that such a legal right will significantly raise awareness of Union citizenship among Europeans; recalls that transparency and democratic participation must be achieved by a variety of forms of partnership among the EU and Member States, regional and local institutions, social partners and civil society; calls on the Commission to prepare transparent and easily understandable procedures implementing the ‘citizenship initiative’, so that Union citizens are able to effectively initiate legislation immediately after the Treaty of Lisbon enters into force; while it hopes that it will not be necessary, stresses that the Commission should incorporate this right of initiative into its policies regardless of the final status of the Treaty;

À titre de mesure transitoire, et en ce qui concerne les actes de l'Union dans le domaine de la coopération policière et judiciaire en matière pénale qui ont été adoptés avant l'entrée en vigueur du traité de Lisbonne, les attributions des institutions sont les suivantes à la date d'entrée en vigueur dudit traité: les attributions de la Commission en vertu de l'article 258 du traité sur le fonctionnement de l'Union européenne ne seront pas applicables et les attributions de la Cour de justice de l'Union européenne en vertu du titre VI du traité sur l'Union européenne, dans sa version en vigueur avant l'entrée en vigueur du traité de Lisbonne, restent inchangées, y compris lorsqu'elles ont été acceptées conformément à l'article 35, paragraphe 2, dudit traité sur l'Union européenne.
1. As a transitional measure, and with respect to acts of the Union in the field of police cooperation and judicial cooperation in criminal matters which have been adopted before the entry into force of the Treaty of Lisbon, the powers of the institutions shall be the following at the date of entry into force of that Treaty: the powers of the Commission under Article 258 of the Treaty on the Functioning of the European Union shall not be applicable and the powers of the Court of Justice of the European Union under Title VI of the Treaty on European Union, in the version in force before the entry into force of the Treaty of Lisbon, shall remain the same, including where they have been accepted under Article 35(2) of the said Treaty on European Union.
