In order to clarify the relationship between protected traditional terms and trademarks, it is necessary to specify on what legal basis an application for a trademark containing or consisting of a protected traditional term should be assessed in accordance with Directive 2008/95/EC of the European Parliament and of the Council of 22 October 2008 to approximate the laws of the Member States relating to trade marks (3) or Council Regulation (EC) No 207/2009 of 26 February 2009 on the Community trade mark (4).

La directive 98/34/CE du Parlement européen et du Conseil du 22 juin 1998 prévoyant une procédure d’information dans le domaine des normes et réglementations techniques et des règles relatives aux services de la société de l’information (7) ne s’applique pas aux spécialités traditionnelles garanties faisant l’objet du présent règlement.

The traditional specialities guaranteed protected within the Community should be subject to control arrangements, based on Regulation (EC) No 882/2004 of the European Parliament and of the Council of 29 April 2004 on official controls performed to ensure the verification of compliance with feed and food law, animal health and animal welfare rules (5), as well as control arrangements to ensure that operators comply with the product specification before marketing agricultural products and foodstuffs.

Although Mr Napolitano has shown some openness in relation to the traditional positions of the European Parliament, I do not think that his report has yet reached the correct balance in its demands for the extension of the powers of the House, and that it confines the national parliaments to an indirect and, in most cases, illusory role, by placing everything under the vague term of ‘parliamentarisation’.
