1. 1 Where the applicable legislation and/or the competence to grant family benefits change between Member States during a calendar month, irrespective of the payment dates of family benefits under the legislation of those Member States, the institution which has paid the family benefits by virtue of the legislation under which the benefits have been granted at the beginning of this month shall continue to do so until the end of the month in progress.

The application of Article 1 of Regulation (EEC) No 1247/92 may not result in the withdrawal of benefits which are awarded before 1 June 1992 by the competent institutions of the Member States under Title III of Regulation (EEC) No 1408/71 to which Article 10 of the latter Regulation is applicable.

4. Any benefit which has not been awarded or which has been suspended by reason of the nationality or place of residence of the person concerned shall, at the request of that person, be provided or resumed with effect from the date of application of this Regulation in the Member State concerned, provided that the rights for which benefits were previously provided have not given rise to a lump-sum payment.

5. Si la législation d'un État membre prévoit explicitement ou implicitement que les accidents du travail ou les maladies professionnelles survenus ou constatés antérieurement sont pris en considération pour apprécier le degré d'incapacité, l'ouverture du droit aux prestations ou le montant de celles-ci, l'institution compétente de cet État prend également en considération les accidents du travail ou les maladies professionnelles survenus ou constatés antérieurement sous la législation d'un autre État membre, comme s'ils étaient survenus ou avaient été constatés sous la législation qu'elle applique.
5. Where the legislation of a Member State provides explicitly or implicitly that accidents at work or occupational diseases which have occurred or have been confirmed previously shall be taken into consideration in order to assess the degree of incapacity so as to acquire a right to benefits, or to determine the amount thereof, the competent institution of that Member State shall also take into consideration accidents at work or occupational diseases which have occurred or have been confirmed previously under the legislation of another Member State as though they had occurred or had been confirmed under the legislation which it administers.

L'application de l'article 1er ne peut avoir pour effet la suppression de prestations qui étaient accordées antérieurement à l'entrée en vigueur du présent règlement par les institutions compétentes des États membres en application du titre III du règlement (CEE) no 1408/71 et auxquelles est applicable l'article 10 de ce dernier règlement.
1. Application of Article 1 of this Regulation shall not by itself have for effect the withdrawal of benefits granted prior to the entry into force of this Regulation by the competent institutions of the Member States in pursuance of the provisions of Title III of Regulation (EEC) No 1408/71, to which the provisions of Article 10 of that Regulation apply.

2. Si, après suppression des prestations, l'état de l'intéressé vient à justifier l'octroi de nouvelles prestations, celles-ci sont accordées conformément aux dispositions visées à l'article 37 paragraphe 1 ou à l'article 40 paragraphe 1 ou 2, selon le cas.
2. If, after withdrawal of benefits, the condition of the person concerned warrants the granting of further benefits, they shall be granted in accordance with the provisions of Article 37 (1) or Article 40 (1) or (2), as appropriate.
