Building on the experience of mandating procedures gained in specific sectors, for example as a result of the application of Decision No 710/97/EC of the European Parliament and of the Council of 24 March 1997 on a coordinated authorisation approach in the field of satellite personal-communication services in the Community(6) and Decision No 128/1999/EC of the European Parliament and of the Council of 14 December 1998 on the coordinated introduction of a third generation mobile and wireless communications system (UMTS) in the Community(7), technical implementing measures should be adopted as a result of mandates to the CEPT.

La Commission présente au Parlement européen, au Conseil et au Comité économique et social, au plus tard le 1er janvier 2009, et par la suite tous les quatre ans, un rapport sur l'application et les effets de la présente directive en accordant une attention particulière à la compétitivité du marché de l'art moderne et contemporain dans la Communauté, notamment en ce qui concerne la situation de la Communauté à l'égard des marchés importants qui n'appliquent pas le droit de suite de l'artiste et le soutien de la création artistique ainsi que les modalités de gestion dans les États membres.
1. The Commission shall submit to the European Parliament, the Council and the Economic and Social Committee not later than 1 January 2009 and every four years thereafter a report on the implementation and the effect of this Directive, paying particular attention to the competitiveness of the market in modern and contemporary art in the Community, especially as regards the position of the Community in relation to relevant markets that do not apply the resale right and the fostering of artistic creativity and the management procedures in the Member States.
