NOW THEREFORE, under the authority of and subject to the Dominion Water Power Act, the Kananaskis Falls and Horseshoe Falls Water Power Regulations and The Alberta Natural Resources Transfer (Amendment) Act, 1945, this Licence is issued, granting to the Licensee the right to divert and use for power purposes all of the waters of the Bow River at Horseshoe Falls within the area described below for a term of 31 years beginning on October 14, 1997, and the Licence is renewable in accordance with the regulations, as amended from time to time, made under the Dominion Water Power Act and is subject to those regulations as amended from time to time except to the extent the regulations are inconsistent with the terms of this Licence and to any existing rights that were created under the Irrigation Act.

(2) Where a person satisfies the Chief Safety Officer that, for at least the five-year period preceding the date of making an application under this subsection, the person would have qualified for a certificate under these Regulations if the person had applied for one, the Chief Safety Officer may, on application, issue to the person a certificate for the same category as the certificate that the person would have qualified for, and that certificate shall be valid, subject to section 36, 61 or 68, as applicable, for as long as the person is certified to be medically fit in accordance with paragraph 27(b), 53(b) or 64(b), as applicable.

The Commission shall take appropriate implementing measures and make implementation of the relevant standards compulsory by making reference to them as compulsory standards in the list of standards and/or specifications published in the Official Journal of the European Union. 5. Where the Commission considers that standards and/or specifications referred to in paragraph 1 no longer contribute to the provision of harmonised electronic communications services, or that they no longer meet consumers' needs or are hampering technological development, it shall, acting in accordance with the advisory procedure referred to in Article 22(2), remove them from the list of standards and/or specifications referred to in paragraph 1".
