Notes the Court of Justice's policy of giving preference to the use of internal resources, in particular within the translation services; understands the difficulties in finding some language combinations with a legal expertise background; is deeply concerned however with the very high unused appropriations - EUR 2 200 000 - allocated to freelance translation; considers therefore that outsourcing, if needed, should also lead to further savings;

Recalls that there is still room for improvement and more effective use of budget resources in a number of areas and would like to highlight, again, the area of inter-institutional cooperation; agrees with the Court of Auditors that increased cooperation in the field of language services could provide some margin for savings; has therefore made this a priority for 2010 and calls on the institutions to further improve these aspects, including a re-negotiation of the current arrangements in place for the sharing of internal translation resources;

Since subsection 16(3) of the Canadian Constitution provides that the legislatures and Parliament undertake to advance the equality of status or use of English and French, when a province is more generous than the federal government in offering services to its citizens, couldn't we think of a principle, under that subsection or other sections of the Constitution, whereby the federal government would adjust more to the language regime of the province rather than be content with a more minimalist language regime?

If the agreement signed between the federal government and a given province did not include enough money to provide services in French and English, according to a given minority community or according to the Commissioner for Official Languages, or if the agreement did not include a mechanism enabling the province to provide services to the community in English and in French, if the money was transferred but there was no language clause stating that the services must be offered in French and English in certain circumstances, a citizen could appeal the agreement on the grounds that it is inadequate and does not include the appropriate mechanism to promote French and English and help communities which fall under the agreement to develop.

La Cour estime qu'il n'apparaît pas, selon les arguments présentés devant elle, que la suppression de l'exigence d'une autorisation préalable pour les soins non hospitaliers provoquerait des déplacements transfrontaliers de patients d'une importance telle (nonobstant les barrières linguistiques, la distance géographique, les frais de séjour B létranger et le manque dinformations sur la nature des soins) que léquilibre financier du système de sécurité sociale néerlandais en serait gravement perturbé et que le niveau global de protection de la santé publique serait menacé, ce qui pourrait valablement justifier une entrave au principe fondamental de la libre prestation des services.
The Court considers that the arguments put forward before it do not show that removal of the requirement for prior authorisation for non-hospital care would give rise to patients travelling to other countries in such large numbers (despite linguistic barriers, geographic distance, the cost of staying abroad and lack of information about the kind of care) that the financial balance of the Netherlands social security system would be seriously upset and that the overall level of public-health protection would be jeopardised, something which could constitute proper justification for a barrier to the fundamental principle of freedom to provide services.
