NOTING the signature by the High Contracting Parties of the Treaty between the High Contracting Parties and the Republic of Croatia concerning the accession of the Republic of Croatia to the European Union.

I. considérant que l'article 36 du traité sur l'Union européenne (traité UE) dispose que le haut représentant de l'Union pour les affaires étrangères et la politique de sécurité (haut représentant) consulte régulièrement le Parlement européen sur les principaux aspects et les choix fondamentaux de la politique étrangère et de sécurité commune et de la politique de sécurité et de défense commune et l'informe de l'évolution de ces politiques; considérant qu'il convient que le haut représentant veille à ce que les avis du Parlement soient dûment pris en considération;
I. whereas Article 36 of the Treaty on European Union (TEU) provides that the High Representative of the Union for Foreign Affairs and Security Policy (High Representative) is to regularly consult the European Parliament on the main aspects and the basic choices of the common foreign and security policy and the common security and defence policy, and inform it of how these policies evolve; the High Representative is to ensure that the views of the European Parliament are duly taken into consideration;

41. souligne, conformément à l'article 18 du traité UE, les responsabilités du haut représentant/vice-président d'assurer la cohérence des actions extérieures de l'Union européenne; souligne en outre que le haut représentant/vice-président est, conformément aux articles 17 et 36 du traité UE, responsable devant le Parlement et a des obligations à son égard;

12. Notes that, according to Declaration No 12, "appropriate contacts" will be made with Parliament about the nomination by the European Council, with the consent of the President of the Commission, of the first High Representative to take office on the presumed entry into force of the Treaty on 1 January 2009; insists that the spirit of Article 9e of the EU Treaty should be fully applied in the case of this interim appointment (whereby, under Article 9d(7) of the EU Treaty, Parliament would normally have the right of consent to the appointment of the whole Commission, including the High Representative); gives notice, therefore, that it will expect to be fully consulted about this first appointment;

La Conférence déclare que des contacts appropriés seront pris avec le Parlement européen pendant les travaux préparatoires précédant la nomination du haut représentant de l'Union pour les affaires étrangères et la politique de sécurité, qui interviendra à la date de l'entrée en vigueur du traité de Lisbonne, conformément à l'article 18 du traité sur l'Union européenne et à l'article 5 du protocole sur les dispositions transitoires; le mandat du haut représentant commencera à cette même date et durera jusqu'à la fin du mandat de la Commission alors en exercice.

The Conference declares that, in the course of the preparatory work preceding the appointment of the High Representative of the Union for Foreign Affairs and Security Policy which is due to take place on the date of entry into force of the Treaty of Lisbon in accordance with Article 18 of the Treaty on European Union and Article 5 of the Protocol on transitional provisions and whose term of office will be from that date until the end of the term of office of the Commission in office on that date, appropriate contacts will be made with the European Parliament.

Where, following a decision to suspend voting rights adopted pursuant to paragraph 3 of Article 7 of the Treaty on European Union, the Council acts by a qualified majority on the basis of a provision of the Treaties, that qualified majority shall be defined in accordance with Article 238(3)(b) of this Treaty, or, where the Council acts on a proposal from the Commission or from the High Representative of the Union for Foreign Affairs and Security Policy, in accordance with Article 238(3)(a).

13. invite la présidence, la Commission et le haut représentant à une coopération plus étroite afin de parler d'une seule voix sur les questions de politique étrangère commune pour l'énergie et d'adopter une action commune; juge nécessaire de renforcer le rôle de la Commission et du Parlement européen en ce qui concerne la définition d'une politique étrangère commune de l'énergie dans la prochaine révision des traités; propose que, dès l'entrée en vigueur du traité modificatif, soit désigné, avec l'approbation du Conseil et de la Commission, un haut représentant pour la politique étrangère dans le domaine de l'énergie, lequel, portant une "double casquette", serait placé sous l'autorité du nouveau haut représentant de l'Union pour les affaires étrangères et la politique de sécurité et d'un vice-président de la Commission européenne, étant ainsi représenté à la fois au sein du Conseil et de la Commission; souligne que ledit haut représentant serait chargé de la coordination de toutes les politiques relevant de la politique étrangère commune dans le domaine de l'énergie, renforçant ainsi la capacité de l'UE de protéger ses intérêts en matière de sécurité énergétique dans les négociations avec ses partenaires extérieurs;
13. Calls for closer coordination between the Presidency, the Commission and the High Representative so that they may speak and act jointly with one voice on issues concerning a common foreign policy on energy; considers it necessary to strengthen the role of the Commission and the European Parliament in defining the common foreign policy on energy in the forthcoming revision of the Treaties; proposes, after the new Reform Treaty enters into force, to appoint, with the approval of the Council and the Commission, a High Official for Foreign Energy Policy, who, wearing a “double hat”, would act under the authority of the newly created strengthened High Representative of the Union for Foreign Affairs and Security Policy, a Vice-President of the Commission, thus being anchored both in the Council and in the Commission, and who should be responsible for coordinating all policies under the scope of the common European foreign policy on energy, thereby contributing to the EU's ability to protect its energy security interests in negotiating with the EU's external partners;

(11) Il convient que le mandat du Haut-Commissariat des Nations unies pour les réfugiés concernant les réfugiés et d'autres personnes ayant besoin d'une protection internationale soit respecté et qu'il soit donné effet à la déclaration n° 17, annexée à l'acte final du traité d'Amsterdam, relative à l'article 63 du traité instituant la Communauté européenne, aux termes de laquelle il est procédé à des consultations sur les questions touchant à la politique d'asile avec le Haut-Commissariat des Nations unies pour les réfugiés et avec d'autres organisations internationales concernées.
(11) The mandate of the United Nations High Commissioner for Refugees regarding refugees and other persons in need of international protection should be respected, and effect should be given to Declaration No 17, annexed to the Final Act to the Treaty of Amsterdam, on Article 63 of the Treaty establishing the European Community which provides that consultations are to be established with the United Nations High Commissioner for Refugees and other relevant international organisations on matters relating to asylum policy.
