(Return tabled) Question No. 553 Mr. Hoang Mai: With regard to the government’s strategy for combating tax havens: (a) does the government plan to reform the arm’s-length principles under section 247 of the Income Tax Act; (b) has the Canada Revenue Agency (CRA) or any department studied the impact of replacing Canadian Generally Accepted Accounting Principles with International Financial Reporting Standards (IFRS) in terms of (i) taxable impact, (ii) reporting, (iii) tax fraud; (c) has the government studied the possibility of requiring multinational corporations to report on a country-by-country basis on all their transactions, including, (i) labour costs and number of employees, (ii) finance costs, third-party and intra-group transactions, (iii) profits before taxes, (iv) provisions for taxes, (v) taxes actually paid; (d) has the government studied the possibility of providing disclosed information available within federal institutions to provincial Attorneys General for the purpose of civil forfeitures; (e) has the government studied the possibility of lengthening the detention-accountability regime found in section 490 of the Criminal Code; (f) has the government studied the possibility of modernizing the Canada Evidence Act; and (g) what will be the effect of cuts on the CRA auditor capacity to investigate offshore bank accounts and tax havens?

The rapporteur considers that the Commission's proposals have no major impact on the margin under heading 3 of the financial perspective as they would entail an average cost of EUR 24.6 million per year, which is roughly the same as what was dedicated for this purpose in the 2001 budget (EUR 24 million).

Is of the opinion that European Council conclusions are often adopted without adequate examination of possible financial consequences; recalls that the Treaty of Nice, in particular those provisions concerning the responsibilities and the size of the institutions, will also have a considerable impact on heading 5 once it enters into force; recalls that the administrative expenditure of new instruments, such as the European Security and Defence Policy, Judicial Cooperation, Enhanced Cooperation, inter alia, may also have a considerable impact on heading 5; takes the view, therefore, that conclusions on new initiatives ought to be accompanied by an examination of their likely budgetary consequences, including their compatibility with the current ceilings of the financial perspective;

Considers that the inclusion of these activities in the general budget will require increased appropriations in the corresponding headings; reminds that according to the joint statement on financial programming approved on 20 July 2000, the budgetary authority must have accurate information about the financial consequences of each new proposal presented by the Commission; calls on the Commission to present a financial assessment of the post-ECSC activities being phased in the general budget as they may have an impact on the margin under the ceiling of each heading of the financial perspective; stresses the need for further consultation of the budgetary authority should significant changes be made during the renewal of programmes financed under the general budget; believes this to be the only way to ensure that these changes are compatible with the current ceilings of the financial perspective;
