TRADUCTIONS EN CONTEXTE

L’article 145 du règlement (UE) no 1303/2013 s’applique mutatis mutandis lorsque la Commission propose une correction financière visée à l’article 105 du présent règlement.

In order to support Member States in opting for the most favourable technical and financial solution, the Commission should initiate without delay the process of adapting this Regulation by proposing a legal framework for the migration from SIS 1+ to SIS II which better reflects the technical migration approach outlined in the Migration Plan for the SIS Project (the ‘Migration Plan’) adopted by the Commission after a positive vote by the SIS-VIS Committee on 23 February 2011.

With regard to contractual transparency requirements, the proposed regulation does not make a distinction between financial collateral transferred under a ‘title transfer financial collateral arrangement’ and provided under a ‘security financial collateral arrangement’ within the meaning of Directive 2002/47/EC (12).

By contrast under the security financial collateral arrangement the collateral provider provides financial collateral by way of security to or in favour of a collateral taker, and thus the full or qualified ownership of, or full entitlement to, the financial collateral remains with the collateral provider when the security right is established. From a financial stability perspective, the wide scope of the proposed regulation should, in principle, be welcomed.

While the receiving counterparty should nevertheless be obliged to comply with the other requirements under Article 15 of the proposed regulation, it should be clarified that entering into a title transfer financial collateral arrangement already implies a consent to reuse and that any breach of requirements under Article 15 will not affect the validity or enforceability of the SFT, and the receiving counterparty could only be subject to administrative sanctions under the proposed regulation.

The Union offers a privileged relationship, building upon a mutual commitment to shared values and principles, to the countries covered by the European Neighbourhood Instrument.The resources allocated to communication actions under this Regulation could also contribute to institutional communication of the political priorities of the Union as far as they are related to the general objectives of this Regulation.The Programme should be monitored regularly and evaluated independently in cooperation with the Commission and the Member States in order to allow for the readjustments which are necessary if the measures are to be properly implemented.The financial interests of the Union should be protected through proportionate measures throughout the expenditure cycle, including the prevention, detection and investigation of irregularities, the recovery of funds lost, unduly paid or incorrectly used and, where appropriate, administrative and financial penalties in accordance with Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council (7) (hereinafter ‘the Financial Regulation’) and Commission Delegated Regulation (EU) No 1268/2012 (8).Preference should be given to grants for projects irrespective of their size but with a high impact, in particular those which are directly linked to Union policies with a view to participating in the shaping of the Union political agenda.
