That finding cannot be called into question by the wording of Article 97(4) of the Rules of Procedure, which provides that the introduction of an application for legal aid suspends the period prescribed for the bringing of the action until the date of notification of the order making a decision on that application, because in the present case the applicant did not apply for legal aid until 18 November 2009, that is to say, when the time-limits for bringing actions against all three of the abovementioned decisions of the selection board had already expired.

If, in cases involving third countries which have concluded equivalence agreements with the Community, the Commission, after making enquiries of the competent authorities of the third countries concerned, concludes that they have failed to fulfil their obligations and the guarantees given by the plans referred to in Article 29(1), it shall cease to allow the country concerned, under the regulatory procedure referred to in Article 33(2), to benefit from the said agreements for the animals and products in question until that third country has made good its shortcomings. The suspension shall be revoked under the same procedure’.

4. Sans préjudice des dispositions particulières du présent règlement, lorsqu’une organisation de producteurs n’effectue pas une communication à l’État membre exigée dans le présent règlement ou dans le règlement (CE) no 1182/2007 ou si la communication apparaît incorrecte à la lumière des faits objectifs en possession de l’État membre, ce dernier suspend l’approbation du programme opérationnel concerné pour l’année suivante jusqu’à ce que la communication soit effectuée correctement.
4. Without prejudice to specific provisions in this Regulation, where a producer organisation fails to make a communication to the Member State as required under this Regulation or Regulation (EC) No 1182/2007 or if the communication appears incorrect in the light of objective facts in the Member State's possession, the Member State shall suspend approval for the relevant operational programme for the following year until the communication is correctly made.
