La Commission a proposé une refonte du règlement PIC pour 1) clarifier certaines définitions et aligner le présent règlement sur la législation adoptée récemment en matière de produits chimiques, 2) associer l'Agence européenne des produits chimiques (AEPC) à la mise en œuvre du présent règlement, 3) modifier les dispositions concernant la représentation extérieure de l'Union de manière à ce que seule la Commission représente l'Union dans le cadre de la convention de Rotterdam, et non plus les États membres, et 4) modifier les règles de consentement préalable en connaissance de cause de sorte que les exportateurs de produits chimiques soumis au règlement PIC puissent exporter plus facilement lorsqu'ils n'obtiennent aucune réponse.
The Commissions has proposed a recast of the PIC-regulation in order to 1) clarify certain definitions and align the regulation with recent chemical legislation adopted recently, 2) involve the European Chemical Agency (ECHA) in the implementation of the regulation, 3) change the provisions related to external representation of the Union so that it is only the Commission and not the member states who represents the Union in the Rotterdam Convention, and 4) change the rules of prior informed consent in order to make easier for exporters of chemicals regulated by the PIC-regulation to export in the cases where no response is forthcoming.

Selon le règlement PIC, de nouvelles notifications pour l'exportation de chaque produit chimique doivent être faites chaque année civile.
Under the PIC Regulation, new notifications for export of each chemical have to be made every calendar year.

De surcroît, afin d’éviter les exportations non désirées, il convient qu’aucun produit chimique interdit ou strictement réglementé dans l’Union et répondant aux critères de notification en vertu de la convention ou relevant de la procédure PIC ne soit exporté sans le consentement explicite du pays importateur concerné, que ce dernier soit ou non partie à la convention.
Furthermore, in order to prevent undesired exports, no chemicals banned or severely restricted within the Union that meet the criteria for notification under the Convention or that are subject to the PIC procedure should be exported unless the explicit consent of the importing country concerned has been sought and obtained, whether or not that country is a Party to the Convention.

Néanmoins, il paraît approprié que les articles, tels que définis dans le présent règlement, qui renferment des produits chimiques qui sont susceptibles d’être libérés dans l’environnement dans certaines conditions d’utilisation ou d’élimination et qui sont interdits ou strictement réglementés dans l’Union pour une ou plusieurs des catégories d’utilisation définies dans la convention, ou soumis à la procédure PIC, soient également soumis aux règles de notification d’exportation.
Nevertheless, it seems appropriate that articles, as defined in this Regulation, containing chemicals that could be released under certain conditions of use or disposal and that are banned or severely restricted in the Union within one or more of the use categories laid down in the Convention or are subject to the PIC procedure should also be subject to the export notification rules.

7)«produit chimique soumis à la notification d’exportation», tout produit chimique interdit ou strictement réglementé dans l’Union dans une ou plusieurs catégories ou sous-catégories, ainsi que tout produit chimique soumis à la procédure PIC, figurant à l’annexe I, partie 1.
(7)‘chemical subject to export notification’ means any chemical that is banned or severely restricted within the Union within one or more categories or subcategories, and any chemical listed in Part 1 of Annex I that is subject to the PIC procedure.

Il est à noter que lorsque des produits chimiques énumérés dans la présente partie de l’annexe sont soumis à la procédure PIC, les obligations de notification d’exportation définies à l’article 8, paragraphes 2 à 4, du présent règlement ne s’appliquent pas, pour autant que les conditions énoncées à l’article 8, paragraphe 6, premier alinéa, points b) et c), soient réunies.
It should be noted that where chemicals listed in this part of the Annex are subject to the PIC procedure, the export notification obligations set out in Article 8(2), (3) and (4) shall not apply provided that the conditions laid down in points (b) and (c) of the first subparagraph of Article 8(6) have been fulfilled.
