Afin de favoriser la prévisibilité au-delà de l’application du règlement d’exemption par catégorie et de limiter l’analyse détaillée aux cas susceptibles de soulever de réels problèmes de concurrence, la Commission considère qu’en dehors des restrictions caractérisées, une infraction à l’article 101 du traité est peu probable lorsqu’il existe, outre les technologies contrôlées par les parties à l’accord, au moins quatre technologies indépendantes substituables à la technologie concédée à des coûts comparables pour l’utilisateur.
In order to promote predictability beyond the application of the TTBER and to confine detailed analysis to cases that are likely to present real competition concerns, the Commission takes the view that outside the area of hardcore restrictions Article 101 of the Treaty is unlikely to be infringed where there are four or more independently controlled technologies in addition to the technologies controlled by the parties to the agreement that may be substitutable for the licensed technology at a comparable cost to the user.
