7. constate que la corruption est largement étendue en Croatie et qu'elle demeure un problème général majeur; salue l'action menée par le gouvernement croate pour s'opposer vigoureusement à toutes les formes de corruption; souligne que le gouvernement a porté une attention particulière au cadre juridique et institutionnel de la lutte contre la corruption, notamment en matière d'instruction, de poursuites et de coopération au niveau international et entre agences; prend acte des affaires de corruption actuellement très médiatisées dans lesquelles sont impliqués un ancien premier ministre, deux anciens ministres, de hauts fonctionnaires et plusieurs dirigeants d'entreprises publiques; compte sur des procès transparents et justes, et rappelle aux autorités croates qu'il importe de soustraire les procédures d'enquête en matière de corruption à toute intervention politique; salue la création de pôles spécialement chargés de la lutte contre la corruption et le crime organisé dans les quatre plus grands tribunaux du pays, où les juges, ayant été soumis à un contrôle, reçoivent une formation complémentaire; prie l'OLAF de collaborer étroitement avec les autorités croates afin de faire la lumière sur les risques potentiels de générer une corruption secondaire au sein des institutions de l'Union européenne;
7. Notes that corruption seems to have been widespread in Croatia and remains a serious overall problem; welcomes the efforts of the Croatian Government to take a strong stance against all forms of corruption; stresses that the Government gave special attention to the legal and institutional framework for fighting corruption, including investigations, prosecutions and inter-agency and international cooperation; takes note of the high-profile anti-corruption cases under way involving a former Prime Minister, two former ministers, high-profile civil servants and numerous general managers of state-owned firms; expects transparent and fair trials and reminds the Croatian authorities of the importance of protecting the corruption investigation process from political interference; welcomes the creation of special anti-corruption and organised crime departments in the four largest courts in the country, where judges are screened and receive additional training; requests OLAF to closely cooperate with the Croatian authorities in order to shed light on the potential secondary corruption which may be generated within the EU Institutions;

Heureuse dans son principe, une telle initiative pose toutefois un problème institutionnel majeur : le démembrement de la fonction exécutive, traditionnellement dévolue collégialement à la Commission, entre des personnalités singulières, ne disposant en tant que telles d'aucun moyen administratif ou financier significatif et ne rendant compte de leur action à aucune assemblée parlementaire, constitue une dérive préoccupante de la vie institutionnelle de l'Union.
This initiative, while welcome in principle, nonetheless poses a major institutional problem: the splitting-up between individual figures of the executive role traditionally conferred on the Commission as a collective body, where those figures as such are not backed up by proper administrative or financial resources and are not accountable to any parliamentary body, constitutes a disturbing trend in the Union’s institutional life.

Le projet de Constitution proposé par la Convention est à la fois innovant et peu concluant: innovant par l'abolition de la structure actuelle des traités et les nombreuses innovations institutionnelles et procédurales, mais peu concluant parce qu'il n'aborde pas certains problèmes constitutionnels majeurs qui persisteront dans un avenir prévisible.
The draft Constitution proposed by the Convention is innovative and indecisive at the same time: innovative in its abolition of the present treaty structure and its many institutional and procedural innovations, indecisive in not tackling some big constitutional issues which will stay with the Union for the foreseeable future.
