Upon termination or expiration of this Agreement, this Funding Agreement shall remain in force in respect of any actual or contingent liability or exposure under any Operation, until any such liability or exposure has been written off or determined to be unrecoverable and any applicable statute of limitation has expired and in particular, EIF shall be entitled to retain such amounts as may be required under this Agreement or any Operation Agreement for the payment of any amount owed thereto or the satisfaction of any accrued or contingent obligations under outstanding Operations.

Une assurance ou autre garantie financière ne satisfait pas aux prescriptions du présent article si elle peut cesser d’avoir effet, pour une raison autre que l’expiration de la période de validité indiquée dans le certificat en vertu du paragraphe 2 du présent article, avant l’expiration d’un délai de trois mois à compter du jour où préavis en a été donné à l’autorité spécifiée au paragraphe 5 du présent article, à moins que le certificat n’ait été restitué à cette autorité ou qu’un nouveau certificat n’ait été délivré avant la fin de ce délai.

An insurance or other financial security shall not satisfy the requirements of this article if it can cease, for reasons other than the expiry of the period of validity of the insurance or security specified in the certificate under paragraph 2 of this article, before three months have elapsed from the date on which notice of its termination is given to the authorities referred to in paragraph 5 of this article, unless the certificate has been surrendered to these authorities or a new certificate has been issued within the said period.
