Welcomes the observations provided by ECA in its Special Report No 4/2011 on the SME Guarantee facility; calls on the European Investment Fund, which manages the facility on behalf of the Commission, to implement the ECA’s recommendations as soon as possible; notes the observations of the ECA published in its Special Report 4/2011 on the audit of the SMEG facility with regard to the scarcity of factual evidence presented in the impact assessment in support of the facility, the unclear objectives of the scheme, the lack of specific targets and the cases where beneficiaries could have obtained loans on the market without publicly supported guarantees; welcomes, at the same time, the achievements identified in the Special Report 4/2011, including the establishment of an appropriate management framework as well as a well-designed framework for selection of beneficiaries, and the introduction of clear and reasonable reporting requirements that do not impose an excessive burden on SMEs;

Welcomes the simultaneous ratification of the AA/DCFTA by the Verkhovna Rada and the European Parliament; considers this an important step which shows the commitment of both sides to successful implementation; takes note of the eventual postponement of the provisional implementation of the EU-Ukraine DCFTA until 31 December 2015, to be replaced by the prolongation of unilateral trade measures which represent a de facto asymmetrical implementation of the agreement; deplores the extraordinary measures and level of pressure exerted by Russia; states that the agreement cannot and will not be changed and that this has been made very clear by the European Union through this ratification; calls on the Member States to swiftly proceed with the ratification of the AA/DCFTA with Ukraine; takes note of the ongoing consultation between Ukraine, Russia and the EU on the implementation of the AA/DCFTA with Ukraine and hopes that it will help solve any misunderstandings;

Notes the Secretary-General’s reply indicating that the cost of the LUX prize was reduced, as proposed by the Committee on Budgetary Control and voted in plenary in the 2010 discharge report; notes that a series of concrete measures have been taken in order to minimise the LUX Prize expenditure, in particular cutting costs related to promotional activities at international festivals and within Parliament premises; takes note that the expenditure of LUX Prize in 2012 was EUR 434 421, which represents a reduction of 24 % as compared to 2011 (EUR 573722); calls for further efficiencies to be found;

Hopes that those responsible for the assassination of Benazir Bhutto are identified and held responsible as soon as possible; notes the worsening human rights situation in Pakistan throughout 2007, including in particular the threats to the independence of the judiciary and the freedom of the media; with that in mind, condemns the defamation campaign against Iftikhar Mohammad Choudhry, former Chief Justice of Pakistan, as well as the fact that he has been removed from office and placed under house arrest; calls on the Council and the Commission to support the movement for democracy started by the judiciary and the bar, particularly by extending invitations to some of their representatives, including Mr Choudhry; calls for the reinstitution of all deposed judges; notes the adoption of a new Country Strategy Paper for Pakistan and welcomes the mainstreaming of conflict prevention and human rights throughout that document; notes that the first meeting of the European Community-Pakistan Joint Commission was held in Islamabad on 24 May 2007 and stresses the need for human rights to be at the forefront of the agenda for all subsequent meetings;

Deplores documented human rights violations by Pakistan including in Gilgit and Baltistan, where allegedly violent riots took place in 2004, and the all too frequent incidents of terror and violence perpetrated by armed militant groups; urges Pakistan to revisit its concepts of the fundamental rights of freedom of expression, freedom of association and freedom of religious practice in AJK and Gilgit and Baltistan, and notes with concern allegations by human rights associations such as Amnesty International of torture and detention without due process; strongly urges all parties involved to do all they can to address these violations; welcomes Pakistan's public commitments to curb infiltration across the LoC by militants operating out of territory under its control, but believes it must take much stronger and more effective measures; urges a continuing and determined commitment by President Musharraf to fighting terrorism, which, it is widely recognised, presents enormous challenges; approves and supports multilateral and bilateral EU Member State aid to assist Pakistan in fighting terrorism and in making determined efforts to improve the lives of the people of AJK and Gilgit and Baltistan; furthermore, calls on the Government of Pakistan and EU Member States to intensify their efforts to identify and apprehend potential terrorist recruits coming to Pakistan from EU Member States; welcomes the recent establishment by the two governments of a joint panel, the India-Pakistan Joint Mechanism on Terrorism, to combat terrorism and share intelligence, and notes that the first meeting of the panel took place in Islamabad on 6 March 2007;

Apart from the cases provided for in paragraph 1 of this Article, each Member State shall take the necessary measures to ensure that a legal person can be held liable where the lack of supervision or control by a person referred to in paragraph 1 of this Article has made possible the commission of the conduct referred to in Articles 1 and 2 for the benefit of that legal person by a person under its authority.
