Estimant que la publication de ces photographies avait enfreint ses droits d'auteur, M Painer a demandé aux tribunaux autrichiens d'ordonner aux éditeurs de presse de cesser de reproduire et/ou de distribuer les photographies et le portrait-robot sans son consentement et sans indication de son nom en tant qu'auteur.
Since Ms Painer considered that those photographs infringed her copyright, she applied to the Austrian courts for an order that the publishers immediately cease the reproduction and/or distribution, without her consent and without indicating her as author, of the photographs and photo-fit.
