where the designated authority of the home Member State of the institution sets the countercyclical buffer rate for a third country pursuant to Article 139(2) or (3), or recognises the countercyclical buffer rate for a third country pursuant to Article 137, that buffer rate shall apply from the date specified in the information published in accordance with Article 139(5)(c) or Article 137(2)(c), if the effect of that decision is to increase the buffer rate.

2. 2. Where the third country concerned has given a legal undertaking to provide the assistance required to gather evidence of the irregular nature of transactions which appear to contravene legislation on excise duties, information obtained under this Regulation may be communicated by the competent authority of a Member State to that third country, in accordance with that Member State’s national law regarding transfers of personal data to third countries, for the purposes of the correct application of excise duties or similar taxes, duties and charges applicable in the third country with the consent of the competent authorities which supplied the information, in accordance with their national law.

When appropriate, and in conformity with Community law, agreements recognising that the security standards applied in a third country are equivalent to Community standards could be envisaged in aviation agreements between the Community and a third country in accordance with Article 300 of the Treaty, in order to advance the goal of ‘one-stop security’ for all flights between the European Union and third countries.

3. La participation des pays bénéficiaires aux programmes communautaires se conforme aux modalités particulières définies pour chaque programme dans le protocole d'accord à conclure entre la Commission et le pays bénéficiaire, conformément aux accords établissant les principes généraux de participation des pays bénéficiaires aux programmes communautaires.
3. The participation of beneficiary countries in Community programmes shall follow the specific terms and conditions set out for each such programme in the memorandum of understanding to be concluded by the Commission and the beneficiary country, in accordance with the agreements establishing the general principles for participation of the beneficiary countries in Community programmes.

6. Si des mesures financées au titre du présent règlement sont mises en oeuvre de façon centralisée indirecte, par délégation à des organismes communautaires spécialisés, des organismes publics nationaux et internationaux ou des organismes de droit privé investis d'une mission de service public, conformément à l'article 54, paragraphe 2, point c, du règlement (CE, Euratom) no 1605/2002, la participation aux procédures de marchés publics ou de contrats de subvention mises en œuvre par l'entité gestionnaire est ouverte aux personnes physiques ressortissantes des pays ayant accès aux marchés et subventions communautaires, conformément aux principes énoncés au paragraphe 1 du présent article, ainsi qu'à tout autre pays éligible conformément aux règles et procédures de l'entité gestionnaire, de même qu'aux personnes morales établies dans un tel pays.
6. If measures financed under this Regulation are implemented on a centralised basis and indirectly by delegation to specialised Community bodies, international or national public sector bodies, or bodies governed by private law with a public service mission in accordance with Article 54(2)(c) of Regulation (EC, Euratom) No 1605/2002, participation in the public procurement and grant award procedures of the managing entity shall be open to natural persons who are nationals of the countries having access to Community contracts and grants in accordance with the principles set out in paragraph 1 of this Article, and of any other country eligible under the rules and procedures of the managing entity, and to legal persons which are established in those countries.
