invite, dès lors, le gouvernement à traiter ces problèmes de manière systématique en modifiant la législation et en veillant à sa bonne mise en œuvre à tous les niveaux des pouvoirs publics, y compris les municipalités; attire également l'attention dans ce contexte sur les recommandations adoptées par la commission de Venise, au printemps 2010, concernant le statut juridique des communautés religieuses et le droit du patriarcat orthodoxe d'user du titre «œcuménique»; salue la récente décision de l'«assemblée des fondations» de céder la propriété de l'orphelinat grec de garçons de Büyükada au patriarcat œcuménique, conformément à l'arrêt de la Cour européenne des droits de l'homme, et l'octroi de la nationalité turque à plusieurs membres du clergé grec orthodoxe afin de faciliter l'activité du patriarcat et du saint-synode; se réjouit de la cérémonie religieuse célébrée dans le monastère de Sumela, transformé en musée, à Trabzon, et de la cérémonie célébrée en l'église de l'île d'Akdamar, dans la province de Van; juge regrettable la décision rendue par la cour suprême turque à l'encontre du monastère de Mor Gabriel concernant un litige foncier avec des villages et le Trésor turc; renouvelle son souhait de voir les déclarations du gouvernement relatives à la réouverture du séminaire orthodoxe grec de Halki soient suivies incessamment d'actions concrètes et de mesures permettant la formation sans obstacles du clergé des communautés chrétiennes; demande instamment au gouvernement d'être particulièrement attentif au matériel didactique utilisé dans les écoles, lequel doit refléter le pluralisme religieux de la société turque et tenir compte de la nécessité d'utiliser du matériel pédagogique sans parti pris;
Calls, therefore, on the Government to address these issues systematically by amending legislation and by ensuring its proper implementation at all levels of government, including the municipalities; points too, in this context, to the recommendations adopted by the Venice Commission in spring 2010 concerning the legal personality of religious communities and the ecclesiastical title ‘Ecumenical’ of the Orthodox Patriarchate; welcomes the recent decision by the ‘Foundations Assembly’ to transfer the Büyükada Greek Orphanage for Boys to the Ecumenical Patriarchate, in accordance with the ruling of the European Court of Human Rights, and the granting of Turkish citizenship to several Greek Orthodox clergy in order to facilitate the Patriarchate and the Holy Synod; welcomes the religious ceremony in the Sümela Monastery Museum in Trabzon and the ceremony in the church on Akdamar Island in the province of Van; finds the Turkish Supreme Court decision against Mor Gabriel Monastery, concerning a land dispute with villages and the Turkish Treasury, to be regrettable; restates its expectation that the Government’s announcements about the reopening of the Halki Greek Orthodox seminary will soon be followed by action and by measures providing for the unhindered training of Christian communities’ clergy; urges the Government to pay special attention to educational materials in schools, which should reflect the religious plurality of Turkish society, and to the need for unbiaised learning materials;

10. encourage le gouvernement de la Turquie, suite à la mesure positive que constitue l'adoption de la loi sur les fondations, à donner suite aux engagements qu'il a pris quant à la liberté de religion en établissant, conformément au CEDH et à la jurisprudence de la Cour européenne des droits de l'homme, un cadre juridique permettant à toutes les communautés religieuses de fonctionner sans contraintes excessives, en particulier pour ce qui concerne leur statut juridique, la formation du clergé, l'élection de la hiérarchie, l'éducation religieuse et la construction de lieux de culte; demande la protection du patrimoine religieux et culturel; renouvelle son appel concernant la réouverture immédiate du séminaire orthodoxe grec de Halki et l'usage public du titre ecclésiastique de patriarche œcuménique; partage les préoccupations exprimées par le Conseil le 24 juillet 2007 en ce qui concerne l'arrêt de la Cour de cassation turque relatif au patriarcat œcuménique et espère que cette décision ne contrariera pas encore davantage l'exercice par le patriarcat et d'autres communautés religieuses non musulmanes de leurs droits garantis par la CEDH;

Encourages the Turkish government, following the positive step taken with the adoption of the Law on Foundations, to fulfil its commitments regarding freedom of religion by establishing, in line with the ECHR and the case-law of the European Court of Human Rights, a legal framework enabling all religious communities to function without undue constraints, in particular as regards their legal status, the training of clergy, the election of the hierarchy, religious education and the construction of places of worship; calls for protection of the religious and cultural heritage; reiterates its call for the immediate re-opening of the Greek Orthodox Halki Seminary and the public use of the ecclesiastical title of the Ecumenical Patriarch; shares the concern expressed by the Council on 24 July 2007 over the ruling of the Turkish Court of Cassation on the Ecumenical Patriarchate, and expects that this decision will not further impede the exercise by the Patriarchate and other non-Muslim religious communities of their rights guaranteed under the ECHR;

How does the Council intend to intervene directly to protect the Ecumenical Patriarchate, given that statements of this kind have, even very recently, triggered acts of terrorism and 'spontaneous' demonstrations by extremist elements against the Ecumenical Patriarchate?
