U. whereas the draft EU negotiation text on Sanitary and Phytosanitary Measures tabled for the round of 29 September-3 October 2014 suggests obliging Parties to apply tolerances and maximum residue levels set by the Codex Alimentarius Commission within 12 months after their adoption, unless the importing Party had signalled a reservation at the Codex Alimentarius Commission meeting; whereas there is a general pattern of lower amounts of pesticide residues allowed in food in the EU as compared with the Codex Alimentarius Commission; whereas over the last four years, the European Food Safety Authority (EFSA) has filed a reservation in 31-57 % of all cases, which highlights the large degree of disagreement by EFSA with the Codex standards; whereas EFSA currently feels free to express its reservations, within the limits possible; whereas once the TTIP has been adopted, however, it is highly questionable whether EFSA will be allowed politically to continue to do so, given that the draft text intends to commit the EU and the US to collaborate in the international standard setting bodies ‘with a view to reaching mutually satisfactory outcomes’, which could discourage EFSA from filing reservations to the Codex Alimentarius Commission in the future and thus lead to weaker standards in the EU;

3. 3. If the Agency does not receive from the importing Party or other country an acknowledgement of receipt of the first export notification made after the chemical is included in Part 1 of Annex I within 30 days of the dispatch of such notification, it shall, on behalf of the Commission, submit a second notification.

In the case of chemicals listed in Parts 2 or 3 of Annex I, the designated national authority of the exporter may, in consultation with the Commission assisted by the Agency and on a case-by-case basis, decide that the export may proceed if, after all reasonable efforts, no response to a request for explicit consent pursuant to paragraph 6(a) has been received within 60 days and there is evidence from official sources in the importing Party or other country that the chemical has been licensed, registered or authorised or that it has in the last 5 years been used in, or imported into the importing Party or importing other country and no regulatory action has been taken to prohibit its use.

That is true, in particular, of Article 5 of the Convention, which establishes a procedure for the exchange of information concerning actions taken by the parties to the Convention in order to ban or severely restrict the use of a chemical product on their territory, and from Article 12 of the Convention, which imposes on the same parties an obligation to send an export notification to the importing party where a banned or severely restricted chemical is exported from their territory and which, with a view to ensuring transparency, also calls on the latter party formally to acknowledge receipt of that notification.

Reference may in particular be made, in that connection, to the obligation imposed on the parties to the Convention to establish the import regime applicable to the products that are subject to that procedure (Article 10(1) to (5)), the disclosure of the essential elements of that regime to any natural or legal person with an interest (Article 10(8)) or the obligation imposed on exporting parties to ensure compliance by exporters within their jurisdiction with the regimes laid down by the importing parties and, in particular, to prohibit, subject to clearly circumscribed exceptions, any export of the products listed in Annex III to the Convention to a party to the Convention which has not notified to the secretariat the import regime applicable to those products or has merely notified to it an interim response not containing a decision concerning the interim import regime (Article 11(1)(b) and (2)).

2. 2 If a developing country Party or non-Party of Import or a Party or non-Party with an economy in transition has declared through the BCH that it will take a decision prior to an import of a specific GMO intended for direct use as food or feed, or for processing, according to Article 11.6 of the Protocol, the exporter shall not proceed with the first export of such GMO unless the process provided for under that provision has been followed.

The main provision in this regard is the requirement that a Party that plans to export a chemical that is banned or severely restricted for use within its territory, must inform the importing Party that such export will take place, before the first shipment and annually thereafter (the so-called “export notification” procedure) until the chemical becomes subject to the PIC procedure and the importing party has provided an import response for the chemical which has been distributed to the Parties.
