In accordance with Regulation (EU, Euratom) No 966/2012 of the European Parliament and of the Council (1) and Commission Delegated Regulation (EU) No 1268/2012 (2) and with the other rules referred to in this Agreement, the grant agreements and/or contracts concluded with participants in the programmes and activities established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of the participants and of their subcontractors by Commission agents or by other persons mandated by the Commission.

In accordance with Council Regulation (EC, Euratom) No 1605/2002 of 25 June 2002 and Commission Regulation (EC, Euratom) No 2342/2002 of 23 December 2002 laying down detailed rules for the implementation of Council Regulation (EC, Euratom) No 1605/2002, and with the other provisions referred to in this Agreement, the contracts concluded with programme participants established in Switzerland may provide for scientific, financial, technological or other audits to be conducted at any time on the premises of participants or their subcontractors by Commission staff or other persons mandated by the Commission.

2 ter. Lorsque les États membres participants ont déjà établi des dispositifs nationaux de financement pour les procédures de résolution, ils peuvent prévoir que ces dispositifs utilisent les moyens financiers dont ils disposent, collectés auprès des établissements avant l'entrée en vigueur de la [directive relative au redressement des banques et à la résolution de leurs défaillances], pour dédommager les mêmes établissements des contributions ex-ante qu'ils pourraient devoir verser au Fonds.
2b. Where participating Member States have already established national resolution financing arrangements, they may provide that the national resolution financing arrangements use their available financial means, collected from institutions before the entry into force of Directive [BRRD], to compensate institutions for the ex–ante contributions which those institutions may be required to pay into the Fund.

2 ter. Lorsque les États membres participants ont déjà établi des dispositifs nationaux de financement des procédures de résolution, ils peuvent prévoir que ces dispositifs utilisent les ressources financières dont ils disposent, collectées dans le passé auprès des établissements sous forme de contributions ex ante, pour dédommager les mêmes établissements des contributions ex ante qu'ils pourraient devoir verser au Fonds.
2b. Where participating Member States have already established national resolution financing arrangements, they may provide that the national resolution financing arrangements use their available financial means, collected from institutions in the past by way of ex-ante contributions, to compensate institutions for the ex-ante contributions which those institutions may be required to pay into the Fund.

3. Les organes et entités légalement établis dans des pays tiers, autres que ceux participant au programme conformément au paragraphe 1, points b) et c), en particulier les pays où s'applique la politique européenne de voisinage, peuvent être associés aux actions du programme à leurs propres frais, dans la mesure où cela contribue au but poursuivi par ces actions.
3. Bodies and entities legally established in third countries, other than those participating in the Programme in accordance with points (b) and (c) of paragraph 1, in particular countries where the European Neighbourhood Policy applies, may be associated to the actions of the Programme at their own cost, if this serves the purpose of those actions.

3. Bodies and entities legally established in third countries, other than those participating in the Programme in accordance with points (b) and (c) of paragraph 1, in particular countries where the European Neighbourhood Policy applies, may be associated to the actions of the Programme at their own cost, if this serves the purpose of those actions.

4 bis. La participation d'entités juridiques établies dans des pays tiers au programme-cadre "Horizon 2020" ou à certaines parties de ce programme-cadre est soumise au principe de réciprocité selon lequel les entités juridiques établies dans l'Union peuvent participer aux programmes de recherche et d'innovation initiés par ces pays.
4a. Participation by legal entities established in third countries in the Horizon 2020 framework programme or parts thereof shall be subject to the principle of reciprocity, according to which legal entities established in the Union may participate in research and innovation programmes initiated by those countries.
