Les agents temporaires qui sont employés au sein des institutions, organes ou organismes de l’Union au titre de l’article 2, point a), du régime applicable aux autres agents et qui sont engagés par le Parquet européen dans le cadre d’un contrat conclu avant que le Parquet européen soit devenu opérationnel conformément à la décision visée à l’article 120, paragraphe 2, et au plus tard un an après, se voient offrir des contrats au titre de l’article 2, point f), du régime applicable aux autres agents, toutes les autres conditions du contrat demeurant inchangées, sans préjudice de la nécessité de respecter les obligations découlant du régime applicable aux autres agents.

Temporary agents employed under point (a) of Article 2 of the Conditions of Employment in the institutions, bodies, offices or agencies of the Union who are engaged by the EPPO with a contract concluded before and no later than 1 year after the EPPO becomes operational in accordance with the decision mentioned in Article 120(2) shall be offered contracts under point (f) of Article 2 of the Conditions of Employment whereas all other conditions of the contract shall remain unchanged, without prejudice to the need to respect the obligations stemming from the Conditions of Employment.

Temporary agents employed under point (f) of Article 2 of the Conditions of Employment and contract agents employed under Article 3a of the Conditions of Employment in the institutions, bodies, offices or agencies of the Union who are engaged by the EPPO with a contract concluded before and no later than 1 year after the EPPO becomes operational in accordance with the decision mentioned in Article 120(2) shall be offered contracts under the same conditions.

2. Les agents contractuels qui sont employés au sein des institutions de l’Union au titre de l’article 3 bis ou de l’article 3 ter du régime applicable aux autres agents et qui sont engagés par le Parquet européen dans le cadre d’un contrat conclu avant que le Parquet européen soit devenu opérationnel conformément à la décision visée à l’article 120, paragraphe 2, et au plus tard un an après, se voient offrir des contrats au titre de l’article 3 bis du régime applicable aux autres agents, toutes les autres conditions du contrat demeurant inchangées.
2. Contract agents employed under Article 3a or 3b of the Conditions of Employment in the institutions of the Union who are engaged by the EPPO with a contract concluded before and no later than 1 year after the EPPO becomes operational in accordance with the decision mentioned in Article 120(2) shall be offered contracts under Article 3a Conditions of Employment whereas all other conditions of the contract shall remain unchanged.

Pour répondre à ce besoin, il convient de faciliter le recrutement par le Parquet européen d’agents temporaires ou contractuels qui travaillent déjà au sein des institutions, organes ou organismes de l’Union, en garantissant à ces agents le maintien de leurs droits contractuels s’ils sont recrutés par le Parquet européen au cours de sa phase de mise en place jusqu’à un an après que le Parquet européen sera devenu opérationnel conformément à la décision mentionnée à l’article 120, paragraphe 2.
With a view to meeting that need, the recruitment by the EPPO of temporary and contract agents already working in the institutions, bodies, offices or agencies of the Union should be facilitated by guaranteeing those staff members continuity of their contractual rights if they are recruited by the EPPO in its set-up phase until 1 year after the EPPO becomes operational in accordance with the decision in Article 120(2).

Notes that although the Agency became operational as early as in 2005 to present it has only worked on the basis of correspondence and exchanges with the host Member State rather than a comprehensive headquarters agreement between the Agency and the host Member State, which has never been signed; agrees therefore with the Court that such an agreement would further promote transparency in respect of the conditions under which the Agency and its staff operate; asks the authorities of the host Member State to remedy the situation and calls on the Agency to include the implications of the missing agreement in its next annual activity report;

Calls for a European Public Prosecutor’s Office to be established as provided for in Article 86 TFEU, in particular to combat, investigate, prosecute and bring to judgement crimes affecting the EU’s financial interests and serious offences of a crossborder nature; recommends that the future office should have an efficient and streamlined structure and should be given the task of coordinating and encouraging national authorities so as to make investigations more coherent through uniform procedural rules; considers it essential that the Commission should present a proposal before September 2013 clearly defining the structure of the European Public Prosecutor’s Office, its accountability to the European Parliament and, in particular, its interaction with Europol, Eurojust, OLAF and the Fundamental Rights Agency, and that the EPPO should be supported by a clear procedural rights framework, with the offences over which it is to have authority being clearly defined;
